Cinemas (Rural Areas) Bill

To

Make provision about cinemas in rural areas.                                                            

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Discretionary relief for rural cinemas

(1)   

Section 47 of the Local Government Finance Act 1988 (c. 41) (discretionary

relief) is amended as follows.

(2)   

In subsection (2) after paragraph (c) there is inserted—

“(d)   

the hereditament is not an excepted hereditament, and all or

part of it is a rural cinema.”

(3)   

After subsection (9) there is inserted—

“(10)   

The meaning of rural cinema in this section shall be prescribed in

regulations made by the Secretary of State.”

Amendment of the Town and Country Planning (Use Classes) Order 1987

(1)   

The Town and Country Planning (Use Classes) Order 1987 (SI 1987/ 764) is

amended, in the Schedule, Part D, Class D2 (assembly and leisure), by omitting

paragraph (a) (cinemas).

Planning contributions in respect of rural cinemas

(1)   

The Planning and Compulsory Purchase Act 2004 (c. 5) is amended as follows.

(2)   

In section 46 (planning contributions), after subsection (4) there is inserted—

“(4A)   

The regulations may make provision for making a contribution in

relation to a rural cinema.

(4B)   

The meaning of “rural cinema” shall be prescribed.”

4       

Short title and extent

(1)   

This Act may be cited as the Cinemas (Rural Areas) Act 2004.

(2)   

This Act extends to England and Wales.
