up planning briefs in respect of the disposal of |

publicly-owned land and property. |

it enacted by the Queen’s most Excellent Majesty,

and Temporal, and Commons, in this present |

Parliament assembled, and
by the authority of the same, as follows:— |

Disposal
of land and design quality |
|
|
(1) |
Section 123 of the Local
Government Act 1972 (c. 70) (disposal of land by |
|
|
principal councils) is amended
as follows. |
|
|
(2) |
In subsection (2) at the
end, there is inserted “subject to subsection (2AA) |
|
|
(3) |
After subsection (2A) there
is inserted— |
|

“(2AA) |
In disposing of land under
subsection (1), a council must satisfy itself |
|
|
that
the prospective purchaser has a plan for the land which will secure
|
|
|
|
|
(2AB) |
The form of plans under
subsection (2AA) shall be prescribed by |
|
|
regulations
made by the Secretary of State. |
|

(2AC) |
If the Secretary of State
is not satisfied that a council has adequately |
|
|
performed
its duty under subsection (2AA), he may order it to hold a |
|
|
|
|
(2AD) |
The form of, and procedure
for conducting, a design competition under |
|
|
under
subsection (2AC) shall be prescribed by regulations made by the
|
|

(2AE) |
In exercising his powers
under subsection (2AD) the Secretary of State |
|
|
shall
consult the principal council and the Commission for Architecture
|
|
|
and
the Built Environment.” |

Amendment
of the Planning (Listed Buildings and Conservation Areas) Act
|
|
|
|
|
(1) |
The Planning (Listed Buildings
and Conservation Areas) Act 1990 (c. 9) is |
|
|
|
|
(2) |
In section 17 (power to
impose conditions on grant of listed building consent), |
|

after subsection (3) (b)
there is inserted— |
|
|
“(c) |
where
the building is publicly-owned, a design competition has |
|
|
been
held in respect of the redevelopment for which the |
|
|
|
|
(4) |
The form of, and procedure
for conducting, a design competition under |
|

subsection
(3)(c) shall be prescribed by regulations made by the |
|
|
|
|
(5) |
In exercising his powers
under subsection (4), the Secretary of State |
|
|
shall
consult the Commission for Architecture and the Built |
|
|
Environment
and the Commission. |

(6) |
In this section “the
Commission” means— |
|
|
(a) |
in
relation to England, the Historical Buildings and Monuments |
|
|
Commission
for England; and |
|
|
(b) |
in
relation to Wales, the Royal Commission on Ancient and |
|
|
Historical
Monuments (Wales).” |
|

|
There
shall be paid out of money provided by Parliament— |
|
|
(a) |
any
expenditure incurred by the Secretary of State by virtue of this
Act, and |
|
|
(b) |
any
increase attributable to this Act in the sums payable out of money
so |
|
|
provided
by virtue of any other enactment. |

Short
title, commencement and extent |
|
|
(1) |
This Act may be cited as
the Disposals of Public Land and Property (Design |
|
|
|
|
(2) |
This Act shall come into
force on such day as the Secretary of State may by |
|
|
|

(3) |
This Act extends to England
and Wales only. |
|
|
|
|
|
