PRAYERS.

1Fourth Standing Committee on Delegated Legislation,—Mr Alan Hurst reported from the Fourth Standing Committee on Delegated Legislation the draft New Opportunities Fund (Specification of Initiative) Order 2004.

2Civil Contingencies Bill,—The Civil Contingencies Bill was, according to Order, read a second time.

3Civil Contingencies Bill (Programme),—A Motion was made, and the Question being put forthwith, pursuant to Orders [28th June 2001 and 6th November 2003 (Programming of Bills)], That the following provisions shall apply to the Civil Contingencies Bill:

Committal

1. The Bill shall be committed to a Standing Committee.

Proceedings in Standing Committee

2. Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on 10th February 2004.

3. The Standing Committee shall have leave to sit twice on the first day on which it meets.

Consideration and Third Reading

4. Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion one hour before the moment of interruption on the day on which those proceedings are commenced.

5. Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on that day.

Programming Committee

6. Sessional Order B (programming committees) made on 28th June 2001 shall not apply to proceedings on consideration and Third Reading.

4Civil Contingencies Bill [Money],—Her Majesty's Recommendation having been signified to the proposed Motion relating to Civil Contingencies Bill [Money];

A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 52 (Money and ways and means resolutions in connection with bills), That, for the purposes of any Act resulting from the Civil Contingencies Bill, it is expedient to authorise the payment out of money provided by Parliament of—

(1) expenditure of a Minister of the Crown in connection with the Act, and

(2) any increase attributable to the Act in sums payable out of money provided by Parliament under another enactment—(Mr Fraser Kemp):—It was agreed to.

5Northern Ireland,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 118 (Standing Committees on Delegated Legislation), That the draft Primary Medical Services (Northern Ireland) Order 2004, which was laid before this House on 17th December, be approved—(Mr Fraser Kemp):—It was agreed to.

6Controls on Fluorinated Greenhouse Gases,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 119 (European Standing Committees), That this House takes note of European Union Document No. 12179/03, draft Regulation on certain Fluorinated Greenhouse Gases; supports the Government's position on reducing greenhouse gas emissions; and notes that the Regulation is in line with the policy on fluorinated gases as set out in the United Kingdom Climate Change

  Programme and that the Regulation is designed to achieve emission reductions of HFCs, PFCs and SF6 and will assist the European Community and Member States to meet their targets under the Kyoto Protocol—(Mr Fraser Kemp):—It was agreed to.

1London Local Authorities Bill [Lords],—The Order of the day being read, for resuming the adjourned Debate on the Question proposed on 7th January, That the promoters of the London Local Authorities Bill [Lords] may, notwithstanding anything in the Standing Orders or practice of this House, proceed with the Bill in the present Session; and the Petition for the Bill shall be deemed to have been deposited and all Standing Orders applicable to it shall be deemed to have been complied with;

That, if the Bill is brought from the Lords in the present Session, a declaration signed by the agent shall be deposited in the Private Bill Office, stating that the Bill is the same in every respect as the Bill brought from the Lords in the last Session;

2European Standing Committee A,—Mr John McWilliam reported from European Standing Committee A the following Resolution:

That the Committee takes note of European Union Document No. 12985/03, draft Directive on the protection of groundwater against pollution; and supports the Government's aim of negotiating a flexible, risk-based instrument, which takes account of the variability of groundwater and its uses, in accordance with the Government's policy of effective groundwater protection.

3Message from the Lords,—A Message was brought from the Lords, as follows:

Disability Discrimination Bill (Joint Committee),—The Lords communicate that they have appointed a Committee of six Lords to join with the Committee appointed by the Commons to consider and report on the draft Disability Discrimination Bill presented to both Houses on 3rd December 2003 (Cm. 6058);

They have ordered that the Committee have power to agree with the Commons in the appointment of a Chairman;

That the Committee have leave to report from time to time;

That the Committee have power to appoint specialist advisers;

That the Committee have power to adjourn from place to place within the United Kingdom;

That the quorum of the Committee shall be two;

That the reports of the Committee from time to time shall be printed, notwithstanding any adjournment of the House; and

That the Committee do report on the draft Bill by the end of April 2004.

4Sustainable Communities Bill,—Sue Doughty, supported by Gregory Barker, Mr David Drew and Mr Simon Thomas, presented a Bill to require the drawing up and implementation of a strategy to promote sustainability among local communities; to make provision for the inclusion of targets and indicators in the strategy; to make provision for councils to implement the strategy in their area; to make provision in respect of the powers of electors in relation to the implementation of the strategy; and for connected purposes: And the same was read the first time; and ordered to be read a second time on Friday 23rd April and to be printed [Bill 41].

5Universal Funded Pensions,—Ordered, That leave be given to bring in a Bill to require people to save for a guaranteed pension sufficient to avoid reliance on means-tested benefits: And that Mr Peter Lilley, Mr David Cameron, Mr Gerald Howarth, Mr Andrew Mitchell, Mr John Maples, Mr David Ruffley and Andrew Selous do prepare and bring it in.

6Universal Funded Pensions Bill,—Mr Peter Lilley accordingly presented a Bill to require people to save for a guaranteed pension sufficient to avoid reliance on means-tested benefits: And the same was read the first time; and ordered to be read a second time on Friday 15th October and to be printed [Bill 40].

7Opposition Day [3rd allotted day],—It being an allotted day at the disposal of the Leader of the Opposition in pursuance of Standing Order No. 14 (Arrangement of public business), the House proceeded to consider Opposition business.

Case for a Civil Service Bill,—A Motion was made, and the Question being proposed, That this House calls on the Government to introduce a Civil Service Bill in this Parliamentary Session—(Mr Kenneth Clarke);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House' to the end of the Question and add the words ‘welcomes the Government's commitment, in its response to the Ninth Report of the Committee on Standards in Public Life, to publish a draft Civil Service Bill for consultation; acknowledges the contribution made to the discussion of these issues in recent days by the Select Committee on Public Administration; notes the failure of any previous Conservative Government

to legislate for the Civil Service; and welcomes this Government's commitment to reforming and modernising the Civil Service to ensure that it continues to deliver a first class service to the people of this country', instead thereof.—(Mr Douglas Alexander.)

Resolved, That this House welcomes the Government's commitment, in its response to the Ninth Report of the Committee on Standards in Public Life, to publish a draft Civil Service Bill for consultation; acknowledges the contribution made to the discussion of these issues in recent days by the Select Committee on Public Administration; notes the failure of any previous Conservative Government to legislate for the Civil Service; and welcomes this Government's commitment to reforming and modernising the Civil Service to ensure that it continues to deliver a first class service to the people of this country.

Voting Rights for Honourable Members Representing Scottish Seats,—A Motion was made, and the Question being proposed, That this House deplores the practice of Right honourable and honourable Members representing Scottish constituences voting on bills concerning issues that have been devolved to the Scottish Parliament, especially those which introduce in England measures that have been rejected in Scotland; condemns the unfairness that this represents to those in English constituencies and the Government's failure to address the problem; notes that it is the practice of the honourable Member for Galloway and Upper Nithsdale voluntarily to abstain from voting on such legislation; calls on other Right honourable and honourable Members representing Scottish constituencies similarly to abstain from such votes; and believes that the fairest long-term solution is for bills on areas of policy which have been devolved to Scotland to be so ratified by the Speaker and for Right honourable and honourable Members from Scottish constituencies to abstain from voting on such bills—(Mr Peter Duncan);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House' to the end of the Question and add the words ‘believes that Parliament is the Parliament for the whole of the United Kingdom, and that all Right honourable and honourable Members are equal in status and have a right to speak and vote on all matters brought before Parliament; and opposes any step that would undermine the Union of the United Kingdom', instead thereof.—(Mrs Anne McGuire.)
