That the Committee takes note of European Union Document No. 5916/04, draft Council Decision authorising the placing on the market of sweet corn from genetically modified maize line Bt11; and supports the Government's view that the sweet corn meets the necessary requirements for authorisation under Regulation (EC) No. 258/97.

4Telecommunications (Permitted Development Rights) (Amendment) Bill,—Jim Dowd accordingly presented a Bill to amend the Town and Country Planning (General Permitted Development) Order 1995 to require that the erection of a telecommunications mast can only take place under permitted development rights when it has been shown that the operator has complied with the Code of Practice of the operators of mobile telecommunications systems: And the same was read the first time; and ordered to be read a second time on Friday 21st May and to be printed [Bill 95].

That the Committee takes note of European Union Document No. 15494/03, draft Directive on batteries and accumulators and spent batteries and accumulators; supports the Government's intention to welcome the draft Directive and supports the Government's aim of securing legislation that achieves a high level of environmental protection and harmonisation of the single market, at lowest cost, taking a risk-based and proportional approach, and of ensuring that final collection and recycling targets for spent portable batteries and accumulators are challenging, but achievable.

4Message from the Lords,—A Message was brought from the Lords, as follows:

9Opposition Day [7th allotted day: second part],—It being an allotted day at the disposal of the Leader of the Opposition in pursuance of Standing Order No. 14 (Arrangement of public business), the House proceeded to consider Opposition business.

Government's Record on Animal and Plant Diseases,—A Motion was made, and the Question being proposed, That this House recognises the potential risk posed to British agriculture and to the environment of the UK by the importation of animal and plant diseases; acknowledges the crucial importance of preventing diseases from entering the country; notes with concern the increase in the number of diseases in Britain emanating from abroad and the spread of virulent epidemics across the world; recognises the implications for biosecurity of the enlargement of the European Union; condemns the Government for failing to learn the lessons from the recent outbreak of foot and mouth disease; regrets the failure of the Government to address these problems and to instil confidence in the farming community; and calls on the Government to take urgent action to put in place the stringent measures necessary to prevent animal and plant disease from entering the UK—(Mrs Theresa May);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House' to the end of the Question and add the words ‘commends the action taken by this Government to eradicate exotic plant and animal disease when it occurs, and to control endemic disease; congratulates the Government on its actions that have succeeded in reducing the number of BSE clinical cases to just 184 last year; further congratulates the Government on eradicating a major outbreak of Foot and Mouth Disease in seven months and on implementing the recommendations of the Lessons Learned and Royal

Society Inquiries so that Government is better prepared to tackle a future outbreak of a major livestock disease; welcomes the significant progress made to tackle illegal imports both by increasing enforcement activity at the border and by increasing public awareness; applauds the Government on its action taken against other animal and plant diseases, notably Salmonella Java and potato ring rot; and notes the Government's continuing commitment to prevent serious animal and plant disease', instead thereof.—(Mr Ben Bradshaw.)

The Commons insist on their disagreement to Lords Amendment No. 3 for the following Reason:

Because it is not appropriate to create more than one tier of regional spatial strategy.

The Reason was agreed to.

11Draft Charities Bill (Joint Committee),—Ordered, That the Lords Message of 19th April, relating to a Joint Committee of both Houses to consider and report on any draft Charities Bill presented to both Houses by a Minister of the Crown, be now considered.

That this House concurs with the Lords that it is expedient that a Joint Committee of Lords and Commons be appointed to consider and report on any draft Charities Bill presented to both Houses by a Minister of the Crown, and that the Committee shall report on the draft Bill by 30th September 2004.

That a Select Committee of six honourable Members be appointed to join with the Committee appointed by the Lords to consider the draft Charities Bill.

That the Committee shall have power—

(i) to send for persons, papers and records;

(ii) to sit notwithstanding any adjournment of the House;

(iii) to report from time to time;

(iv) to appoint specialist advisers;

(v) to adjourn from place to place within the United Kingdom; and

That the quorum of the Committee shall be two.

‘(4A) The registers shall contain such information and documents that relate to the requirements placed on local authorities under the Sustainable Energy Act 2003, outlining any achievements beyond the statutory minimum in pursuit of warm homes and energy conservation.'.—(Mr John Hayes.)

(a) current and proposed accessible residential properties in the local authority area (whether purpose-built or adapted) with details of the access features relating to each property; and

(b) the provisions available for disabled people who require accessible housing.
