2Gambling Bill,—The Order of the day being read, for the Second Reading of the Gambling Bill;

And a Motion being made, and the Question being proposed, That the Bill be now read a second time;

An Amendment was proposed to the Question, to leave out from the word ‘That' to the end of the Question and add the words ‘this House declines to give a Second Reading to the Gambling Bill since it fails to take account of the recommendations of the Joint Committee on the Draft Bill with regard to regional casinos; consequently fails to impose adequate controls on the number and location of such casinos and on the number and type of gambling machines contained; does not give local authorities sufficient powers to reject specific casino applications; opens the door to an influx of overseas owned super casinos in our towns and cities, close to where people live; and is likely to promote gambling and lead to further diversion of funds from the National Lottery, severe disadvantage to the existing UK gaming industry and a significant increase in problem gambling', instead thereof.—(Mr John Whittingdale.)

Committal

1. The Bill shall be committed to a Standing Committee.

Proceedings in Standing Committee

2. Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on 11th January 2005.

3. The Standing Committee shall have leave to sit twice on the first day on which it meets.

Consideration and Third Reading

4. Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion one hour before the moment of interruption on the day on which those proceedings are commenced.

5. Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on the day on which proceedings on consideration are commenced.

6. Sessional Order B (programming committees) made by the House on 28th June 2001 shall not apply to proceedings on consideration and Third Reading.

5Gambling Bill [Money],—Her Majesty's Recommendation having been signified to the proposed Motion relating to Gambling Bill [Money];

A Motion was made, and the Question being put forthwith pursuant to Standing Order No. 52 (Money resolutions and ways and means resolutions in connection with bills), That, for the purposes of any Act resulting from the Gambling Bill, it is expedient to authorise the payment out of money provided by Parliament of—

(1) expenditure of a Minister of the Crown in connection with the Act, and

(2) any increase attributable to the Act in sums payable out of money provided by Parliament under another enactment—(Mr John Heppell):—It was agreed to.

6Gambling Bill [Ways and Means],—A Motion was made, and the Question being put forthwith pursuant to Standing Order No. 52 (Money resolutions and ways and means resolutions in connection with bills), That, for the purposes of any Act resulting from the Gambling Bill, it is expedient to authorise—

(1) the imposition of a levy to be paid by holders of operating licences and to be expended on social projects connected with gambling,

(2) the imposition of a penalty on holders of operating licences who fail to ensure compliance with licence conditions, and

(3) the payment of sums into the Consolidated Fund—(Mr John Heppell):—It was agreed to.

7General Arrangements for Excise,—A Motion was made, and the Question being put forthwith pursuant to Standing Order No. 119 (European Standing Committees), That this House takes note of European Union Document No. 8241/04, Commission Report and draft Council Directive relating to Directive 92/12/EEC on the general arrangements for products subject to excise duty and on the holding, movement and monitoring of such products; and welcomes the principle of reducing administrative burdens for businesses but supports the United Kingdom Government's position that the ‘distance-purchasing' elements of the current proposal are unacceptable, as they weaken the United Kingdom's law enforcement and revenue-raising ability—(Mr John Heppell):—It was agreed to.

8Immigration,—Ordered, That the Nationality, Immigration and Asylum Act 2002 (Specification of Particularly Serious Crimes) Order 2004 (S.I., 2004, No. 1910), dated 22nd July 2004, be referred to a Standing Committee on Delegated Legislation.—(Mr John Heppell.)

9Defence,—Ordered, That Mr Crispin Blunt be discharged from the Defence Committee and Richard Ottaway be added.—(Mr John McWilliam, on behalf of the Committee of Selection.)

That the Committee takes note of European Union Document No. 12343/04, draft Council Decision concerning the placing on the market, in accordance with Directive 2001/18/EC, of an oilseed rape product (Brassica napus L., GT73 line) genetically modified for glyphosate tolerance; and supports the Government's view that, although expert advice indicates that there probably are no safety concerns, it can adopt a position on authorisation under Directive 2001/18/EC only on receipt of satisfactory data from a further rat feeding study using 15% oilseed rape meal.

2Message from the Lords,—A Message was brought from the Lords, as follows:

The Lords do not insist on one of their Amendments to the Armed Forces (Pensions and Compensation) Bill to which this House has disagreed; they do not insist on their other Amendment to which this House has disagreed but propose an Amendment in lieu thereof.

6Members' Allowances,—A Motion was made, and the Question being proposed, That—

(1) This House notes the recommendations made in Chapter 4 of the report of the Review Body on Senior Salaries on parliamentary pay and allowances (Cm. 6354–1) a copy of which was laid before this House on 21st October; and is of the opinion that the provisions set out in paragraphs (2) to (5) below should be implemented, subject to any decisions of the Members Estimate Committee with regard to their application.

Staffing Allowance

(2) With effect from 1st April 2005, the Staffing Allowance should be increased to a base level of £72,000, rising to a maximum of £80,460, according to the number of full-time equivalent employees funded from the Staffing Allowance and based in London; and these sums should be adjusted on 1st April each year (beginning on 1st April 2005) in line with the Average Earnings Index for public and private sectors combined.

IT Provision

(3) With effect from the beginning of the next Parliament, the level of provision of IT equipment and support should be increased in line with recommendations 11 and 12 of the Review Body's report (Cm. 6354–1).

London Supplement

(4) With effect from 1st April 2005, the London Supplement should be increased to £2,500, and this sum should be adjusted on 1st April each year (beginning on 1st April 2005) in line with the Average Earnings Index for public and private sectors combined; and it should not be payable to any Member who receives the Additional Costs Allowance.

Car Mileage Allowance and Parking

(5) With effect from 1st April 2005, the Car Mileage Allowance should be payable at the same rate as the car mileage rates approved by the Inland Revenue, with the higher rate payable up to a total of 10,000 miles and the lower rate thereafter or as determined in future by the Inland Revenue; and the cost of parking a car, motorcycle or bicycle, if wholly, exclusively and necessarily incurred in the performance of parliamentary duties, should be reimbursed.

Incidental Expenses Provision

(6) That recommendation 8 of the Review Body's report (Cm. 6354–1) be referred to the House of Commons Members Estimate Committee for further consideration—(Mr Peter Hain);

8Parliamentary Pensions (Survivor Benefits and Early Retirement),—Resolved, That this House notes recommendation 3 contained in the report of the Review Body on Senior Salaries on parliamentary pay and allowances (Cm. 6354–1), a copy of which was laid before this House on 21st October, and is of the opinion that, subject to consultation with the Trustees of the PCPF and the Government Actuary as to the detailed implementation, the proposals set out in paragraphs (1) to (3) below should be adopted as a package which is, overall, at least cost neutral to the Exchequer:

(1) Pensions calculated on the same basis as pensions for widows and widowers should be introduced for surviving unmarried partners of members in service on or after 3rd November 2004.

(2) Pensions for the widows, widowers and unmarried partners of members in service on or after 3rd November 2004 should be payable for life.

(3) The early retirement provisions which permit a member who has accrued at least 15 years service to retire before the age of 65 on favourable terms should be removed for those who become members of the scheme after 3rd November 2004 and phased out for existing members from 1st April 2009, or the day after the general election after next, whichever is the later.—(Mr Phil Woolas.)

9Sessional Orders and Resolutions,—A Motion was made, and the Question being proposed, That this House takes note of the Third Report of the Procedure Committee, Session 2002–03, on Sessional Orders and Resolutions, House of Commons Paper No. 855, and the Government's Response thereto (published as the Committee's Third Special Report of the current Session, House of Commons Paper No. 613); approves the proposals set out in paragraphs 9, 10 and 25 of the Report for changes in the practice of the House at the beginning of each Session; and, as recommended in paragraph 9(b), makes the following provision:
