ORDER IN COUNCIL

Letter to the Clerk of the Committee from the Parliamentary Relations and Devolution Department, Foreign and Commonwealth Office, 10 November 2003

  The Government, in its response to the Committee's 1999 report on Sierra Leone[8], undertook to report Orders made under the United Nations Act 1946 to the Committee when they have been made by Her Majesty in Council. The 1999 report mentioned that any sanctions Order approved by an FCO Minister should be brought to the attention of the Committee; but is not clear that this refers only to such Orders made under the UN Act. I therefore enclose an Order made under the Saint Helena Act 1833, the British Settlements Act 1 887 & 1945, and the Royal Prerogative on 8 October 2003 and laid before Parliament on 9 October 2003. The Order implements within the Overseas Territories a resolution 1493 (2003) adopted by the United Nations Security Council on 28 July 2003 requiring Member States to impose an arms and related technical assistance embargo in parts of the Democratic Republic of the Congo, and a Common Position adopted by the Council of the European Union on 17 September 2003 which applies the measures in Resolution 1493 to the whole of the territory of the Democratic Republic of the Congo, and is entitled as follows:

  The Democratic Republic of Congo (Restrictive Measures) (Overseas Territories) Order 2003[9]
