Motorcycles in bus lanes

Road charging referendums

To move the following Clause:—

    '(1)   No congestion or other road user charge or payment intended to be levied upon the driver of a motor vehicle for using a specific road or entering a locality during specified times shall be so levied in any part of the United Kingdom unless public approval for such a charge has been obtained by the person or authority seeking to introduce the same.

    (2)   In this section, "public approval" means obtaining the support of at least fifty per cent. of those voting in a referendum held for this purpose in the local authority area in which the road or roads intended to be subject to the charge is situated.'.


Amendment of Road Traffic Act 1988

To move the following Clause:—

    'The Road Traffic Act 1988 (c.52) is further amended, by inserting after section 80 (approval marks)

       "80A Retro-reflective markings

       The Secretary of State may by regulations made by statutory instrument require the fitting of retro-reflective tape complying with ECE 104 to international category vehicles N2 and N3 and on goods trailers under the international classification 03 and 04 newly registered in the UK".'.


Amendment of traffic signs regulations and general directions 2002

To move the following Clause:—

    '(1)   The Traffic Signs Regulations and General Directions 2002 (S1/2002/3113) are amended as follows.

    (2)   In paragraph 4, after the definition of "excursion or tour", there is inserted—

       "fixed speed camera" means a camera of a type approved by the Secretary of State that is situated at a fixed site and that operates continuously or from time to time for the purpose of monitoring the speed of road vehicles and securing compliance with the speed limit in force at that site.

    (3)   After paragraph 58 there is inserted—"59. E

       "59 very fixed speed camera shall—

      (a) be adequately illuminated during the hours of darkness and

      (b) have affixed to it a clearly visible indication of the applicable speed limit.".'.


Road Accident Investigation Service

To move the following Clause:—

    '(1)   Within 12 months of the coming into force of this Act the Secretary of State shall by regulations establish a Road Accident Investigation Service (2the Service") which shall—

      (a) investigate the causes of road accidents particularly where they result in death or serious injury,

      (b) commission and publish the results of research into the causes and consequences of road accidents, and

      (c) make recommendations to the Secretary of State.

    (2)   Regulations under this section may provide for the organisation, operation and powers of the Service.

    (3)   The Secretary of State may make financial provision for the Service.

    (4)   The power to make regulations under this section is exercisable by statutory instrument.

    (5)   No regulations shall be made under this section unless a draft of the regulations has been laid before, and approved by a resolution of, each House of Parliament.'.


Amendment of Road Traffic Act 1988

    'In section 41 of the Road Traffic Act 1988 (c.52) (regulation of construction, weight, equipment and use of vehicles), at the end of subsection (2) insert—

          "(m) for prohibiting the modification of or retrofitting to the front of a motor vehicle any equipment which in the opinion of the Secretary of State may render the vehicle more likely to cause injury to a third party in the event of an accident.".'


Duty to protect character of countryside

    'Highway Authorities in England shall be under a duty to have regard to the desirability of protecting the character of the countryside in undertaking their activities.'.

    'The Secretary of State shall make regulations subject to such exemptions as he shall specify requiring persons driving or riding in motor vehicles of any class specified in the regulations to wear compliant reflective garments when leaving the vehicle at a roadside except where such vehicle is properly and lawfully parked.'.

ORDER OF THE HOUSE [11TH JANUARY 2005]

That the following provisions shall apply to the Road Safety Bill:

Committal

    1.   The Bill shall be committed to a Standing Committee.

Proceedings in Standing Committee

    2.   Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on Thursday 3rd February 2005.

    3.   The Standing Committee shall have leave to sit twice on the first day on which it meets.

Consideration and Third Reading

    4.   Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion one hour before the moment of interruption on the day on which those proceedings are commenced.

    5.   Proceedings on the Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on that day.

Programming Committee

    6.   Standing Order No. 83B (Programming committees) shall not apply to proceedings on consideration and Third Reading.

Other Proceedings

    7.   Any other proceedings on the Bill (including any proceedings on consideration of Lords Amendments or any further messages from the Lords) may be programmed.


ORDER OF THE COMMITTEE [20TH JANUARY 2005]

That—

    (1)   during proceedings on the Road Safety Bill the Standing Committee (in addition to its first meeting on Thursday 20th January at 9.25 a.m.) shall meet—

      (a) at 2.30 p.m. on Thursday 20th January,

      (b) at 9.25 a.m. and 2.30 p.m. on Tuesday 25th January,

      (c) at 9.25 a.m. on Thursday 27th January,

      (d) at 9.25 a.m. and 2.30 p.m. on Tuesday 1st February and Thursday 3rd February;

    (2)   the proceedings shall be taken in the following order, namely, Clauses 1 to 4; Schedule 1; Clauses 5 to 8; Schedule 2; Clause 9; Schedule 3; Clauses 10 to 32; Schedule 4; Clauses 33 to 41; Schedule 5; Clauses 42 to 46; Schedule 6; Clauses 47 to 51; new Clauses; new Schedules; any other proceedings relating to the Bill;

    (3)   the proceedings shall (so far as not previously concluded) be brought to a conclusion at 5.30 p.m. on Thursday 3rd February.
