To

amend the Humber Bridge Acts 1959 to 1973; to require the Secretary of State

to review the exercise of his power under the Humber Bridge (Debts) Act

1996; and for connected purposes. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Amendment of the Humber Bridge Act 1959

Composition of Humber Bridge Board

(1)   

The Humber Bridge Act 1959 (ch. xlvi) is amended as follows.

(2)   

In section 6 (constitution of Board), for “22”, substitute “24”.

(3)   

In that section, at the end, insert—

“one member to be appointed by the North Lincolnshire Primary Care

Trust;

one member to be appointed by the North East Lincolnshire Primary Care

Trust.”

Exemption from tolls

(1)   

The Humber Bridge Act 1959 (ch. xlvi) is amended as follows.

(2)   

In section 68 (exemption from tolls), after subsection (4) insert—

“(4A)   

Nothing in this Act shall extend to authorise any tolls to be demanded

or received from any person bearing a ‘toll exemption voucher’ as

defined in section 68A.”

(3)   

After section 68 insert—

“68A    

Toll exemption vouchers

(1)   

For the purposes of section 68(4A), a toll exemption voucher shall be a

voucher produced by the Board and issued exclusively by them to

qualifying persons employed by a Primary Care Trust represented on

the Board.

(2)   

The Board shall arrange for toll exemption vouchers to be printed and

sent to qualifying persons on demand.

(3)   

For the purposes of subsections (2) qualifying persons shall be—

(a)   

the chief executive of a Primary Care Trust; or

(b)   

a person nominated to act in that capacity by the chief executive

of a Primary Care Trust.

(4)   

Qualifying persons shall arrange for the distribution of toll exemption

vouchers to residents in the areas covered by the Primary Care Trusts

represented on the Board who have an identified need to attend

hospitals run by the Hull and East Yorkshire Hospitals NHS Trust for

the following reasons—

(a)   

to receive health care;

(b)   

to visit someone in receipt of health care; or

(c)   

for training related to their work for the National Health

Service.

(5)   

Toll exemption vouchers shall not be issued to a qualifying person until

the qualifying person has lodged with the clerk of the Board a notice

specifying how it is proposed to distribute vouchers in accordance with

subsection (4) and that notice has been approved by the Board.”

Application of revenue

(1)   

The Humber Bridge Act 1959 (ch. xlvi) is amended as follows.

(2)   

In section 75 (application of revenue), for the words from the first word

“undertaking” to the word “Provided”, substitute the words—

“secondly in payment of all other expenses of executing this Act being

expenses properly chargeable to revenue;

thirdly in extending improving and constructing (if the Board think fit)

any works for the purpose of the undertaking;

fourthly in providing working capital (if the Board think fit);

fifthly in providing a reserve fund (if the Board think fit) in accordance

with the next succeeding section;

sixthly in repayment to the constituent authorities mentioned in section

74 (apportionment of deficiency) of this Act of any sums paid to them

by the Board in pursuance of that section;

seventhly in the reduction of tolls which may be demanded taken and

recovered under this Act or for such other purpose as may be approved

by the Minister;

eighthly in payment of the interest on moneys borrowed by the Board

under any statutory borrowing power; and

40

ninthly in providing the requisite appropriations instalments or sinking

fund payments in respect of moneys borrowed by the Board under any

statutory borrowing fund.”

Power of the Secretary of State relating to debts

Review of Humber Bridge (Debts) Act 1996

The Secretary of State shall, from time to time, review the exercise of his power under

section 1(1) of the Humber Bridge (Debts) Act 1996 (c. 1) (power to provide that

certain amounts otherwise payable to the Secretary of State by the Humber Bridge

Board shall not be so payable), having regard to

(a)   

the desirability of reducing tolls on the Humber Bridge annually in real terms;

and

(b)   

the desirability of the Humber Bridge Board no longer having to apply income

from tolls for

(i)   

the payment of interest on moneys borrowed by the Board under

statutory borrowing powers; or

(ii)   

appropriations, instalments or sinking fund payments in respect of

such moneys.

Miscellaneous and final provisions

Expenses

There shall be paid out of money provided by Parliament

(a)   

any expenditure incurred by the Secretary of State in consequence of this Act,

and

(b)   

any increase attributable to this Act in the sums payable out of money so

provided under any other enactment.

6       

Short title

This Act may be cited as the Humber Bridge Act 2005.
