Implementation of Treaty provisions (No. 109)

To move the following Clause:—

    'The Secretary of State may by regulations make provision for one or more of the following purposes—

      (a) implementing an obligation of the United Kingdom created or arising by or under the provisions of the EU Treaty in respect of Protocol on the convergence criteria or a related agreement, or enabling such an obligation to be implemented;

      (b) enabling the exercise of rights enjoyed or to be enjoyed by the United Kingdom under such an agreement; or

      (c) dealing with matters arising out of, or related to, such an obligation or such rights.'.


Implementation of Treaty provisions (No. 110)

      (a) implementing an obligation of the United Kingdom created or arising by or under the provisions of the EU Treaty in respect of Protocol on the Euro Group or a related agreement, or enabling such an obligation to be implemented;

      (b) enabling the exercise of rights enjoyed or to be enjoyed by the United Kingdom under such an agreement; or

      (c) dealing with matters arising out of, or related to, such an obligation or such rights.'.


Implementation of Treaty provisions (No. 111)

    'The Secretary of State may by regulations make provision for one or more of the following purposes—

      (a) implementing an obligation of the United Kingdom created or arising by or under the provisions of the EU Treaty in respect of Protocol on certain provisions relating to the United Kingdom of Great Britain and Northern Ireland as regards economic and monetary union or a related agreement, or enabling such an obligation to be implemented;

      (b) enabling the exercise of rights enjoyed or to be enjoyed by the United Kingdom under such an agreement; or

      (c) dealing with matters arising out of, or related to, such an obligation or such rights.'.


Implementation of Treaty provisions (No. 112)

    'The Secretary of State may by regulations make provision for one or more of the following purposes—

      (a) implementing an obligation of the United Kingdom created or arising by or under the provisions of the EU Treaty in respect of Protocol on certain provisions relating to Denmark as regards economic and monetary union or a related agreement, or enabling such an obligation to be implemented;

      (b) enabling the exercise of rights enjoyed or to be enjoyed by the United Kingdom under such an agreement; or

      (c) dealing with matters arising out of, or related to, such an obligation or such rights.'.

New Clauses Relating To Part 3

Impartiality in broadcasting

To move the following Clause:—

    'Every broadcasting authority and all persons employed by or through any such authority shall take all necessary steps up to and during the referendum campaign to ensure that full impartiality, balance and relevance is observed in the conduct of all interviews, current affairs programmes, editing and reporting as between those arguing for and against the question required to be answered under section 6(2) of this Act.'.


Limits on expenditure

To move the following Clause:—

    '(1)   The Secretary of State shall by order make provision governing the expenditure and the keeping and making of appropriate accounts by participants in the referendum campaign in order to ensure that the maximum expenditure by those advocating a vote against the question set out in section 6(2) of this Act is no greater than the maximum expenditure by those advocating a vote in favour of that question.

    (2)   The European Commission, the European Communities and the European Union shall not in any way participate in the referendum campaign.'.


Proposals for the Intergovernmental Conference

To move the following Clause:—

    'If a greater number of the ballots cast in the referendum to be held under section 6 of this Act constitute no votes than constitute yes votes, Her Majestys Government shall submit to the European Council proposals for the amendment of the Treaties on which the European Communities and the European Union are founded, at a conference held under Article N of the Treaty on European Union, so as to achieve a Union for trade and political co-operation no more integrated than the Communities which existed immediately following the passage of the Single European Act.'.


Bill inconsistent with referendum excluded

To move the following Clause:—

    'A Bill which provides for, or which purports to provide for, the implementation of a Treaty made pursuant to the conference of representatives in section [Proposals for the Intergovernmental Conference] of this Act, shall not be inconsistent with that section and, if it is so inconsistent, shall not be presented to Her Majesty nor receive the Royal Assent under the provisions of this Act.'.


Amendment of Treaties and enactments

To move the following Clause:—

    '(1)   Her Majestys Government shall, notwithstanding any provision of the European Communities Act 1972 or any enactment amending that Act, take all necessary steps to amend any Treaty, Act or enactment so as to ensure compliance with section [Proposals for the Intergovernmental Conference].

    (2)   It is hereby declared that notwithstanding the provisions of the European Communities Act 1972, a Bill or other legislative proposal under this section, once enacted, shall be applied, including by the courts of the United Kingdom, and have effect in the United Kingdom according to its tenor.'.


Results of the referendum to be binding

To move the following Clause:—

    '(1)   The result of the referendum shall be binding in that, if a greater number of ballots cast constitute yes votes than constitute no votes, the Treaty establishing a Constitution for Europe shall be adopted and, if a greater number of ballots cast constitute no votes than constitute yes votes, it shall not be adopted.

    (2)   In the event of a no vote in the referendum, any subsequent Bill seeking to amend the European Communities Act 1972 (c. 68), or any enactment amending that Act, including any provision introduced in compliance with section [Proposals for the Intergovernmental Conference] of this Act, shall be subject to a referendum on its adoption similar to the referendum that shall take place under Part 3 of this Act.'.


ORDER OF THE HOUSE [9th February 2005]

That the following provisions shall apply to the European Union Bill:

Committal

    1.   The Bill shall be committed to a Committee of the whole House.

Proceedings in Committee

    1.     (1)   Proceedings in Committee of the whole House shall be completed in three days.

    (2)   Those proceedings shall be taken in the order shown in the first column of the following Table and shall be brought to a conclusion (so far as not previously concluded) at the times specified in the second column.

    (3)   Standing Order No. 83B (Programming committees) shall not apply to the proceedings on the Bill in Committee of the whole House.

Consideration and Third Reading

    3.   Any proceedings on consideration shall be brought to a conclusion (so far as not previously concluded) one hour before the moment of interruption on the day on which those proceedings are commenced.

    4.   Proceedings on Third Reading shall be brought to a conclusion (so far as not previously concluded) one hour after the commencement of those proceedings or at the moment of interruption on the day on which they are commenced, whichever is the earlier.

    5.   Standing Order No. 83B (Programming committees) shall not apply to proceedings on consideration and Third Reading.

Programming of other proceedings

    6.   Any other proceedings on the Bill (including any proceedings on consideration of Lords Amendments or on any further messages from the Lords) may be programmed.
