Bill

To

introduce a bank holiday on the third Monday in October in recognition of

public service. 

Whereas it is desirable for there to be an additional bank holiday in England and

Wales between the last Monday in August and Christmas, and it is appropriate

to recognise the contribution made to society by those who work for public

services and for the public good:—

Be it therefore enacted by the Queen’s most Excellent Majesty, by and with the

advice and consent of the Lords Spiritual and Temporal, and Commons, in this

present Parliament assembled, and by the authority of the same, as follows:—

Amendment of the Banking and Financial Dealings Act 1971

(1)   

The Banking and Financial Dealings Act 1971 (c. 80) is amended as follows.

(2)   

In paragraph 1 of Schedule 1 (bank holidays in England and Wales), after the

words “the last Monday in August”, insert the words—

“The third Monday in October.”

2       

Steps to recognise public service associated with bank holiday

(1)   

The persons and bodies specified in subsection (2) shall take such steps as they

consider appropriate to promote recognition of public service on and around

the day of the bank holiday which falls on the third Monday in October

(“public service day”).

(2)   

Those persons and bodies are—

(a)   

the Secretary of State,

(b)   

the National Assembly for Wales,

(c)   

local authorities,

(d)   

other public authorities,

(e)   

the House of Commons, and

(f)   

the House of Lords.

(3)   

In this section “public authority” has the same meaning as in section 6 of the

Human Rights Act 1998 (acts of public authorities).

3       

Expenses

There shall be paid out of money provided by Parliament

(a)   

any expenditure incurred by the Secretary of State by virtue of this Act; and

(b)   

any increase attributable to this Act in the sums payable out of money so

provided under any other enactment.

4       

Short title, commencement and extent

(1)   

This Act may be cited as the Public Service (Bank Holiday) Act 2005.

(2)   

This Act comes into force on 1 September 2005.

(3)   

This Act extends to England and Wales only.
