I am sorry it has taken me so long to come back
to you following your letter of 4 November 2004, but I have very
little comment to make upon the Rule.
In the Law Society of Scotland's view, the Rule
is basically sound especially in its application to Jury cases.
I have been unable to detect any groundswell
of opinion which indicates that the Rule needs to be changed.
There is one issue, however, and that is the
application of the Rule to Administrative Tribunals. It may be
appropriate for Administrative Tribunals to be included in the
Rule.
