NORTHERN IRELAND (OFFENCES) BILL:      Second Reading.

    That this House declines to give a Second Reading to the Northern Ireland (Offences) Bill, which fails to protect the human rights of the victims of terrorism; which devalues the courts by introducing an amnesty dressed up as a judicial process and allows those who have been involved in acts of terrorism to escape facing the full rigour of the law; which does not contain a condition that those exiled by terrorist organisations are able to return to Northern Ireland free from threat; and which fails to provide any time limit for the use of its provisions and requires no expression of remorse from those responsible for terrorist activity while permitting some of them to maintain anonymity.

    That this House declines to give a Second Reading to the Northern Ireland (Offences) Bill because it does not contain commencement provisions dependent on General de Chastelain and the Decommissioning Body being satisfied that the exclusion from Northern Ireland of certain persons by paramilitary groups has been totally rescinded and that those persons who remain outside Northern Ireland have made a free will decision.

        That this House declines to give a Second Reading to the Northern Ireland (Offences) Bill because it creates an amnesty for terrorist fugitives from justice; because it allows such fugitives to return to Northern Ireland without ever being arrested or questioned by the police about their alleged offences; because it proposes a quasi-judicial process in which those accused of perpetrating terrorist offences will never have to appear before a court or spend any time in custody; because it allows an indefinite period of time for terrorists to take advantage of this procedure; because it treats members of the Armed Forces and the police on a par with terrorists; because it fails to contain an obligation on terrorist organisations to allow the safe return to Northern Ireland of those they have exiled; and because it places the rights of those suspected of serious offences before those of the victims of terrorism in Northern Ireland and throughout the rest of the United Kingdom.

NORTHERN IRELAND (OFFENCES) BILL (PROGRAMME)

        That the following provisions shall apply to the Northern Ireland (Offences) Bill:

Committal

        1.   The Bill shall be committed to a Standing Committee.

Proceedings in Standing Committee

        2.   Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on Thursday 15th December 2005.

        3.   The Standing Committee shall have leave to sit twice on the first day on which it meets.

Consideration and Third Reading

        4.   Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion one hour before the moment of interruption on the day on which those proceedings are commenced.

        5.   Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on that day.

        6.   Standing Order No. 83B (Programming committees) shall not apply to proceedings on consideration and Third Reading.

Other proceedings

        7.   Any other proceedings on the Bill (including any proceedings on consideration of Lords Amendments or on any further messages from the Lords) may be programmed.
