Miscellaneous and final provisions

Interpretation

In this Act—

“energy conservation authority” has the meaning given in section 1(1) of

the Home Energy Conservation Act 1995 (c. 10);

“fuel poverty” shall be construed in accordance with the provisions of

section 1 of the Warm Homes and Energy Conservation Act 2000 (c. 31);

“licensed electricity supplier” means any person falling within the

definition of “electricity supplier” in section 6(9) of the Electricity Act

1989 (c. 29);

“microgeneration” has the meaning given by section 82 of the Energy Act

2004 (c. 20);

“public authority” has the same meaning as in section 6 of the Human

Rights Act 1998 (c. 42);

“relevant sources of energy and technologies” means the sources of

energy and technologies listed in subsection (7) of section 82 of the

Energy Act 2004.

Orders and regulations

(1)   

Any power of the Secretary of State to make an order or regulations under this

Act is exercisable by statutory instrument.

(2)   

Any order or regulations under this Act (other than regulations under section

10) shall be laid before Parliament after being made and is subject to annulment

in pursuance of a resolution of either House of Parliament.

(3)   

No regulations may be made under section 10 unless a draft of the regulations

has been laid before Parliament and approved by a resolution of each House of

Parliament.

(4)   

Every power conferred by this Act on the Secretary of State to make an order

or regulations includes power—

(a)   

to make different provision for different cases (including different

provision in respect of different areas);

(b)   

to make provision subject to such exemptions and exceptions as the

Secretary of State thinks fit; and

(c)   

to make such incidental, supplemental, consequential and transitional

provision as the Secretary of State thinks fit.

Expenses

There shall be paid out of money provided by Parliament—

(a)   

any expenditure incurred by a Minister of the Crown by virtue of this Act; and

(b)   

any increase attributable to this Act in the sums payable out of money so

provided under any other enactment.

Short title and extent

(1)   

This Act may be cited as the Climate Change and Sustainable Energy Act 2005.

(2)   

Sections 4 to 8 do not extend to Northern Ireland.
