To

Make provision about crime prevention and the built environment.                                        

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

1       

Amendment of the Building Act 1984

(1)   

The Building Act 1984 (c. 55) is amended as follows.

(2)   

After section 15 (consultation with fire and rescue authority), insert—

“15A    

Consultation with police

(1)   

Where, in the case of a requirement contained in building regulations

that relates to the purpose specified in section 1(1)(f) above (furthering

the prevention or detection of crime), the power to dispense with or

relax that requirement conferred by section 8(1) above is by virtue of

section 8(2) above exercisable by a local authority, the local authority

shall, before exercising the power in relation to any premises or

proposed premises, consult the relevant chief officer of police.

(2)   

In subsection (1) above, ‘the relevant chief officer of police’ means the

chief officer of the police of the police force maintained for the police

area in which the premises or proposed premises are located.”

Amendment of the Town and Country Planning Act 1990

(1)   

The Town and Country Planning Act 1990 (c. 8) is amended as follows.

(2)   

After section 71A (assessment of environmental effects), insert—

“71B    

Assessment of crime prevention effects

(1)   

The Secretary of State may by regulations make provision about the

consideration to be given, before planning permission for development

of any class specified in the regulations is granted, to the likely effects

of the proposed development on the prevention of crime or the

reduction of the incidence of crime.

(2)   

The regulations may—

(a)   

impose particular requirements relating to consultation with

the chief officers of police of police forces maintained for a

police area; and

(b)   

make different provision for different classes of development.”

Amendment of the Town and Country Planning (General Development

Procedure) Order 1995

(1)   

The Town and Country Planning (General Development Procedure) Order

1995 (S.I. 1995/419) is amended as follows.

(2)   

In Article 10 (consultations before the grant of permission), in the Table, after

paragraph (zc), insert—

Expenses

There shall be paid out of money provided by Parliament any increase attributable to

this Act in the sums payable out of money so provided under any other enactment.

5       

Short title, commencement and extent

(1)   

This Act may be cited as the Crime Prevention and the Built Environment Act

2005.

(2)   

This Act shall come in to force at the end of a period of two months beginning

with the day on which it is passed.

(3)
