To

Make provision about the detection and treatment of breast cancer.                                      

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

1       

Duty in relation to breast cancer: England

(1)   

It shall be the duty of the Secretary of State to take such steps as he considers

appropriate to improve the rate of detection of breast cancer in women

ordinarily resident in England.

(2)   

In pursuance of the duty under subsection (1), it shall be the duty of the Secretary of

State, in particular, to take all reasonable steps to secure that—

(a)   

women aged over 44 and not aged over 75 ordinarily resident in England are

advised about the desirability of their undergoing breast cancer screening with

the requisite frequency, and

(b)   

breast cancer screening is available free of charge to all women so advised.

Duty in relation to breast cancer: Wales

(1)   

It shall be the duty of the Assembly to take such steps as it considers

appropriate to improve the rate of detection of breast cancer in women

ordinarily resident in Wales.

(2)   

In pursuance of the duty under subsection (1), it shall be the duty of the

Assembly, in particular, to take all reasonable steps to secure that—

(a)   

women aged over 44 and not aged over 75 ordinarily resident in Wales

are advised about the desirability of their undergoing breast cancer

screening with the requisite frequency, and

(b)   

breast cancer screening is available free of charge to all women so

advised.

Interpretation

(1)   

In this Act—

“the Assembly” means the National Assembly for Wales;

“breast cancer screening” means screening of a woman for breast cancer

undertaken using mammography;

“prescribed” means prescribed by regulations made by the relevant

authority;

“the relevant authority” means—

(a)   

in relation to England, the Secretary of State; and

(b)   

in relation to Wales, the Assembly;

“the requisite frequency” means every three years, other than in

prescribed circumstances.

(2)   

Paragraph (b) of section 6 of the Interpretation Act 1978 (c. 30) (words

importing the feminine gender include the masculine) does not apply for the

purposes of interpreting this Act.

Orders and regulations

(1)   

Every power conferred by this Act on the relevant authority to make an order

or regulations is a power exercisable by statutory instrument.

(2)   

A statutory instrument containing regulations made by the Secretary of State

under section 3(1) shall be subject to annulment in pursuance of a resolution of

either House of Parliament.

(3)   

Every power conferred by this Act on a person to make an order or regulations

includes power—

(a)   

to make different provisions for different cases;

(b)   

to make provision subject to such exemptions and exceptions as that

person thinks fit; and

(c)   

to make such incidental, supplemental, consequential and transitional

provision as that person thinks fit.

5       

Expenses

There shall be paid out of money provided by Parliament—

(a)   

any sums to be paid by the Secretary of State for or in connection with the

carrying out of his functions under this Act; and

(b)   

any increase attributable to this Act in the sums which are payable out of

money so provided under any other Act.

6       

Short title, commencement and extent

(1)   

This Act may be cited as the Breast Cancer Act 2006.

(2)   

This Act shall come into force on such day as the relevant authority may by

order appoint.

(3)   

This Act extends to England and Wales.
