    '(3E)   For the purposes of subsection 3(b) of this section it shall not be regarded as appropriate for a local authority to provide childcare in circumstances where there are—

      (a) existing childcare places within one mile, and

      (b) such provision has been graded by Ofsted as either outstanding (grade 1) or good (grade 2).'.
