1 | The Secretary of State shall appoint one of the members of the Tribunal to be |
| |
| |
| |
2 (1) | A person appointed to be a member of the Tribunal shall hold and vacate |
| 15 |
office under the terms of the instrument by which that member is appointed. |
| |
(2) | A member may at any time resign office by notice in writing to the Secretary |
| |
| |
(3) | The Secretary of State may remove a person from office on the ground that— |
| |
(a) | that person has been absent from meetings of the Tribunal for a |
| 20 |
period longer than three consecutive months without the Tribunal's |
| |
| |
(b) | a bankruptcy order has been made against that person or that |
| |
person's estate has been sequestrated or that person has made a |
| |
composition or arrangement with, or granted a trust deed for, that |
| 25 |
| |
(c) | that person is unable or unfit to discharge the functions of a member. |
| |
(4) | If the person appointed to take the chair ceases to be a member that person |
| |
shall also cease to occupy the chair. |
| |
(5) | A person who ceases to hold office as a member of the Tribunal, otherwise |

than by virtue of sub-paragraph (3), or ceases to be chairman shall be eligible |
| |
| |
| |
3 (1) | The Tribunal may appoint such staff as they determine with the Secretary of |
| |
State's approval as to numbers and terms and conditions of service. |

(2) | The Tribunal may in the application of funds provided by the Secretary of State and |
| |
with the Secretary of State’s approval— |
| |
(a) | pay such remuneration, pensions, allowances or gratuities to or in respect |
| |
of any persons who have been or are members of their staff as they may |
| |

(b) | provide and maintain such schemes as they may determine (whether |
| |
contributory or not) for the payment of pensions, allowances or gratuities, |
| |
to or in respect of any such persons. |
| |
(3) | The Secretary of State shall not give an approval under this paragraph |
| |
without the Treasury's consent. |
| 10 |
Remuneration and allowances |
| |
4 (1) | There shall be paid out of funds provided by the Secretary of State to the |
| |
members of the Tribunal such remuneration, travelling and other |
| |
allowances as the Secretary of State may determine. |
| |
(2) | Where the Secretary of State so determines in the case of a holder of the office of |

occupant of the chair or of member of the Tribunal, the Tribunal shall— |
| |
(a) | pay to or in respect of that person such pension, allowances or gratuities, or |
| |
(b) | make such payments towards the provision of a pension, allowances or |
| |
gratuities in respect of that person, |
| |
| as the Secretary of State may determine. |

(3) | A determination under this paragraph shall not have effect unless it has been |
| |
approved by the Treasury. |
| |
| |
5 (1) | Subject to the provisions of this Schedule and of section 3 above, the Tribunal |
| |
may regulate their own procedure, except that the quorum for meetings of |
| 25 |
the Tribunal shall be two. |
| |
(2) | The validity of any proceedings of the Tribunal shall not be affected by any |
| |
vacancy among their members, or by any defect in the appointment of any |
| |
person to the chair or as a member. |
| |
6 | A document purporting to be duly signed on behalf of the Tribunal shall be |

received in evidence and, unless the contrary is proved, be taken to be so |
| |
| |
| |
7 | The Board shall not be regarded as the servant or agent of the Crown or as |
| |
enjoying any status, immunity or privilege of the Crown. |
| 35 |
Parliamentary disqualification |
| |
8 (1) | In the House of Commons Disqualification Act 1975 (c. 24), in Part III of |
| |
Schedule 1 (other disqualifying offices), the following entry shall be inserted |
| |
at the appropriate place— |
| |
| “Member of the Pardons Tribunal”. |
