Administration of statutory leave payments

To move the following Clause:—

    'The Secretary of State shall make regulations providing that any employer employing fewer than 50 persons may transfer to the Secretary of State responsibility for the administration of payments to that person's employees of—

      (a) statutory maternity pay,

      (b) adoption pay,

      (c) additional statutory paternity pay, and

      (d) ordinary paternity pay.'.


Limitation of additional paternity and pay regulations

To move the following Clause:—

    'Regulations made under sections 3 to 10 shall have effect for a period of 12 months beginning with the day on which it is made.'.


Review of additional paternity and pay

To move the following Clause:—

    'The Secretary of State shall review and publish a report on the effectiveness of regulations made under—

      (a) sections 80AA and 80BB of the Employment Rights Act 1996, and

      (b) sections 171ZEA to 171ZEE of the Social Security Contributions and Benefits Act 1992,

    every year in which the regulations are in force beginning 12 months after the regulations are made.'.

    '(4A)   Regulations under this section may not make provision in relation to the subject-matter of the Agricultural Wages (Scotland) Act 1949 (c.30) (as that Act had effect on 1st July 1999).'.

    '41A  In section 106 of ERA 1996 (replacements) in subsection (2)(a) after "adoption leave" insert "or leave under section 80AA or 80BB (additional paternity leave)".'.


ORDER OF THE HOUSE [5th DECEMBER 2005]

That the following provisions shall apply to the Work and Families Bill:

Committal

    1.   The Bill shall be committed to a Standing Committee.

Proceedings in Standing Committee

    2.   Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on Tuesday 20th December 2005.

    3.   The Standing Committee shall have leave to sit twice on the first day on which it meets.

Consideration and Third Reading

    4.   Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion one hour before the moment of interruption on the day on which those proceedings are commenced.

    5.   Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on that day.

    6.   Standing Order No. 83B (Programming committees) shall not apply to proceedings on consideration and Third Reading.

Other proceedings

    7.   Any other proceedings on the Bill (including any proceedings on consideration of Lords Amendments or on any further messages from the Lords) may be programmed.
