Clause 101

 

THE EARL ATTLEE

Page 48, line 42, at end insert—
"(4A)  In the event of an emergency where it is impossible for an application to reach the judge advocate for an extension of custody without charge, the authorisation to keep that person in service custody—
(a)  may be made by the commanding officer's higher authority; and
(b)  may not exceed 96 hours after the arrest.
(4B)  In the event the commanding officer's higher authority granting the authorisation under subsection (4A), the arresting officer must reapply by application to the judge advocate as soon as practicable once communication is re-established."
