     Scrutiny of proposed Orders in Council by Joint Scrutiny Committee

To move the following Clause:—

    '(1)   There shall be a Joint Scrutiny Committee (in this section, "the Committee") that shall scrutinise every Order in Council made pursuant to section 94 of this Act and report on its expediency to the House of Commons and to the National Assembly for Wales.

    (2)   The Committee shall consist of ten Members of the House of Commons and ten Members of the National Assembly of Wales.

    (3)   The Committee may choose its own Chairman and determine its own procedure.'.


     Person filling constituency vacancy to be eligible as constituency member or regional member at subsequent general election

    'A person who has become an Assembly constituency member as a result of an election held under section 10 may be included in a list of candidates for return as Assembly regional members for a particular Assembly electoral region at the subsequent general election even if, at that general election, he is also a candidate to be the Assembly constituency member for an Assembly constituency.'.


     Oath to be taken or affirmation to be made in public

     Limit on number of Ministers (No. 2)

    '(1)   Not more than eight persons are to hold the office of Welsh Minister appointed under section 48 at any time.

    (2)   Not more than three person are to hold the office of Deputy Welsh Minister at any time.'.


     Commencement of provisions relating to candidates at general elections

To move the following Clause:—

    '(1)   Section 7 comes into force on such day after the 2007 election as the Secretary of State may by order appoint.

    (2)   But no order under subsection (1) may be made unless—

      (a) the Secretary of State has undertaken appropriate consultation with—

      (i) the Assembly, and

      (ii) each political party represented in the Assembly, and

      (b) the Electoral Commission has made a report.

    (3)   No order under subsection (1) may be made unless a draft of the statutory instrument containing the order has been laid before, and approved by a resolution of, each House of Parliament.'.


     Composition and chairing of committees

To move the following Clause:—

    '(1)   The provision included in the standing orders in compliance with section 28(3) must meet the requirements of this section.

    (2)   The provision must secure that the membership of each committee and sub-committee reflects the balance of political parties represented in the Assembly.

    (3)   The provision must secure that, taken together, the chairmen of the committees and sub-committees reflect the balance of political parties represented in the Assembly.

    (4)   The provision must secure that the Presiding Officer decides questions arising under provision made in compliance with this section.'.


     Public Expenditure Commission

To move the following Clause:—

    '(1)   Within three months of Royal Assent to this Act, Her Majesty's Government shall establish a commission to make recommendations concerning the future allocation of public expenditure among England, Scotland, Wales and Northern Ireland.

    (2)   The commission referred to in subsection (1) shall be referred to as "the Public Expenditure Commission".

    (3)   The Public Expenditure Commission shall include two members appointed by each of the following—

      (a) the Scottish Parliament,

      (b) the National Assembly for Wales, and

      (c) the Northern Ireland Assembly

    (4)   The Public Expenditure Commission shall include four members appointed by the House of Commons.

    (5)   The Public Expenditure Commission shall publish, within one year following the establishment of the commission, a report setting out recommendations concerning the future allocation of government expenditure among England, Scotland, Wales and Northern Ireland.

    (6)   The Public Expenditure Commission may consider and make recommendations concerning the geographical allocation of public expenditure within England.

    (7)   The Public Expenditure Commission shall be guided in its considerations by the principle that the geographical allocation of public expenditure should be governed by the geographical distribution of the need for public expenditure.

    (8)   The Public Expenditure Commission shall commission statistical research to enable it to carry out its duty under subsection (6).'.


     Welsh language legislation

    '(1)   Sections 106 to 112 and 114 shall come into force on 1st April 2007 in respect of subject 20 in Part 1 of Schedule 7 (the Welsh language).

    (2)   Section 102 shall not apply to the commencement of subsection (1).'.


     Allocation of funds

To move the following Clause:—

    '(1)   The Secretary of State shall appoint a panel of not less than four and not more than six experts to recommend the sums of money to be allocated to the Welsh Consolidated Fund.

    (2)   The Secretary of State shall publish in full the terms of any recommendations made under subsection (1).

    (3)   The panel shall have regard to—

      (a) the principle of fairness,

      (b) the principle of transparency, and

      (c) the particular needs of Wales.'.


     Business scheme

To move the following Clause:—

    '(1)   The Welsh Ministers must make a scheme ("the business scheme") setting out how they propose, in the exercise of their functions, to take account of the interests of business.

    (2)   The business scheme must specify how the Welsh Ministers propose—

      (a) to carry out consultation about the exercise of such of their functions as relate to matters affecting the interests of business, and

      (b) to consider the impact of the exercise of their functions on the interests of business.

    (3)   The Welsh Ministers—

      (a) must keep the business scheme under review, and

      (b) may from time to time remake or revise it.

    (4)   Before making, remaking or revising the business scheme, the Welsh Ministers must consult such organisations representative of business (including trade unions) and such other organisations as they consider appropriate.

    (5)   The Welsh Ministers must publish the business scheme when they make it and whenever they remake it; and, if they revise the scheme without remaking it, they must publish either the revisions or the scheme as revised (as they consider appropriate).

    (6)   If the Welsh Ministers publish a scheme or revisions under subsection (5) they must lay a copy of the scheme or revisions before the Assembly.

    (7)   The Welsh Ministers must—

      (a) within the period of two years beginning with the day on which the business scheme is first made, and

      (b) subsequently at intervals of no more than two years,

    publish a report of how the proposals set out in the business scheme have been implemented.

    (8)   The Welsh Ministers must lay before the Assembly a copy of each report published under subsection (7).'.


     Interval between referendums

To move the following Clause:—

    'No Order in Council under section 102 (1) (other than the first such Order in Council) may be made until four years have elapsed after the referendum held by virtue of the previous Order in Council under subsection (1).'.

    4.   The proceedings shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on the third day.

    5.   Standing Order No. 83B (Programming committees) shall not apply to the proceedings on the Bill in Committee of the whole House.

Consideration and Third Reading

    6.   Proceedings on consideration and Third Reading shall be completed in two days.

    7.   Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion one hour before the moment of interruption on the second day.

    8.   Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on that day.

    9.   Standing Order No. 83B (Programming committees) shall not apply to the proceedings on consideration and Third Reading.

Other proceedings

    10.   Any other proceedings on the Bill (including any proceedings on consideration of Lords Amendments or on any further messages from the Lords) may be programmed.


GOVERNMENT OF WALES BILL (PROGRAMME) (NO. 2)

    1.   Paragraphs 6 to 8 shall be omitted.

    2.   Proceedings on consideration and Third Reading shall be completed in two days.

    3.   Proceedings on consideration shall be taken on each of those days as shown in the first column of the Table and in the order so shown.

    4.   Each part of those proceedings shall (so far as not previously concluded) be brought to a conclusion at the time specified in relation to it in the second column of the Table.
