Parliament assembled, and
by the authority of the same, as follows:— |

Amendment
to the Planning and Compulsory Purchase Act 2004 |

(1) |
The Planning
and Compulsory Purchase Act 2004 (c. 5) is amended
as follows. |

|
(2) |
After section 34 (Guidance)
insert— |
|
|
“34A |
Guidance:
private gardens |
|
|
Guidance
issued under section 34 must have regard to the desirability |
|

of
protecting private gardens from development which is out of |
|
|
character
with the surrounding area.”. |

Short
title, commencement and extent |
|
|
(1) |
This Act may be cited as
the Protection of Private Gardens (Housing |
|
|
|

(2) |
This Act comes into force
at the end of the period of two months beginning |
|
|
with the day on which it
is passed. |
|
|
(3) |
This Act extends to England
and Wales only. |
|
|
|
