To

Protect private gardens from housing development which is out of character

with the surrounding area; and for connected purposes. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Amendment to the Planning and Compulsory Purchase Act 2004

(1)   

The Planning and Compulsory Purchase Act 2004 (c. 5) is amended as follows.

(2)   

After section 34 (Guidance) insert—

“34A    

Guidance: private gardens

Guidance issued under section 34 must have regard to the desirability

of protecting private gardens from development which is out of

character with the surrounding area.”.

Short title, commencement and extent

(1)   

This Act may be cited as the Protection of Private Gardens (Housing

Development) Act 2006.

(2)   

This Act comes into force at the end of the period of two months beginning

with the day on which it is passed.

(3)   

This Act extends to England and Wales only.
