          "5A   Duties to provide advisory services and information on powers to innovate

          (1)   The Secretary of State shall secure that advice and information about making an application for an order under section 2 is available free of charge to any qualifying body.

          (2)   A local education authority shall ensure that each maintained school which they maintain is aware of its ability to make an application for an order under section 2.

          (3)   When conducting an inspection the Chief Inspector may, if he considers it appropriate to do so, report on whether a maintained school is making appropriate use of the powers available under this chapter.

          (4)   School improvement partners appointed under section 5 of the Education and Inspections Act 2006 are required to consider whether an application for an order would be appropriate measure for the purposes of raising standards at the school.".'.

Duties with respect to young carers

    '(1)   A child or young person is a "young carer" for the purposes of this section if he carries out significant caring tasks and assumes a level of responsibility for another person, which would normally be taken by an adult.

    (2)   The headteacher of a maintained school shall nominate a staff member who shall be responsible for identifying young carers, assessing their educational needs and promoting their well-being.

    (3)   A local education authority shall have a duty to promote co-operation between schools and persons or bodies providing services or exercising functions in relation to adults with a view to supporting children with parents who have health or substance misuse problems, or a disability.

    (4)   Where the Chief Inspector carries out an inspection of a maintained school or local authority he shall inspect the performance by it of its functions under this section.'.

          (a) it appears within the top quartile of the value added measure of school performance for three out of the last five years;

          (b) the overall effectiveness of the school has been graded "outstanding" in an inspection by Ofsted within the past three years.".'.

ORDER OF THE HOUSE [15th MARCH 2006]

That the following provisions shall apply to the Educations and Inspections Bill:

Committal

    1.   The Bill shall be committed to a Standing Committee.

Proceedings in Standing Committee

    2.   Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on Thursday 11th May 2006.

    3.   The Standing Committee shall have leave to sit twice on the first day on which it meets.

Consideration and Third Reading

    4.   Proceedings on consideration and Third Reading shall be completed in two days.

    5.   Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion two hours before the moment of interruption on the second day of the proceedings.

    6.   Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on that day.

    7.   Standing Order No. 83B (Programming committees) shall not apply to proceedings on consideration and Third Reading.

    8.   Any other proceedings on the Bill (including any proceedings on consideration of Lords Amendments or on any further messages from the Lords) may be programmed.
