CONSIDERATION OF LORDS MESSAGE

TERRORISM BILL


On Consideration of Lords Reasons for insisting on Amendments and disagreeing to Commons Amendments


Lords Reasons Nos. 5A, 11A, 31A and 34C

   

Mr Secretary Clarke
To move, That this House insists on its disagreement with the Lords in their Amendments 5, 11, 31 and 34 and insists on its Amendment 34B but does not insist on its disagreement with the Lords in their Amendment 28 and proposes the following Amendment in lieu:—

(a)

Page     6,     line     24,     at end insert—

    '(8A)   The reference in subsection (8) to something that is likely to be understood as an indirect encouragement to the commission or preparation of acts of terrorism or Convention offences includes anything which is likely to be understood as—

      (a) the glorification of the commission or preparation (whether in the past, in the future or generally) of such acts or such offences; and

      (b) a suggestion that what is being glorified is being glorified as conduct that should be emulated in existing circumstances.'.

To move the following Amendment to the Bill in lieu of the Lords Amendment:—

Page     2,     line     1,     leave out subsection (4) and insert—

      '( ) for the purposes of this section, "indirect encouragement" comprises the making of a statement referring to terrorism in such a way that the listener, reader or viewer would infer that he should emulate it.'.

To move, That this House insists on its disagreement with the Lords in their Amendment 28.

To move the following Amendment to the words so restored to the Bill:—

(a)

Page     6,     line     27,     leave out from 'offences' to end of line 32 and insert 'comprises the making of a statement referring to terrorism in such a way that the listener, reader or viewer would infer that he should emulate it.'.


ORDER OF THE HOUSE [26TH OCTOBER 2005]

That the following provisions shall apply to the Terrorism Bill:

Committal

    1.  The Bill shall be committed to a Committee of the whole House.

Proceedings in Committee

    2. (1) Proceedings in Committee of the whole House shall be completed in two days.

     (2) Those proceedings shall be taken in the order shown in the first column of the following table and shall be brought to a conclusion (so far as not previously concluded) at the times specified in the second column.

First day                              

Clauses Nos. 1 to 4Three hours after the commencement of proceedings on the Bill on the first day.
Clauses Nos. 23 and 24The moment of interruption on the first day or three hours after the commencement of proceedings on Clause No. 23, whichever is the later.

Second day                              

Clauses Nos. 21 and 22, Clauses Nos. 5 to 20, Schedule No. 1, Clauses Nos. 25 to 27, Schedule No. 2, Clauses Nos. 28 to 36, Schedule No. 3, Clauses Nos. 37 and 38, new Clauses, new Schedules, remaining proceedings on the Bill.The moment of interruption on the second day.

     (3) Standing Order No. 83B (Programming committees) shall not apply to the proceedings on the Bill in Committee of the whole House.

Consideration and Third Reading

    3.  Any proceedings on consideration shall be brought to a conclusion (so far as not previously concluded) six hours after the commencement of those proceedings.

    4.  Proceedings on Third Reading shall be brought to a conclusion (so far as not previously concluded) four hours after the commencement of those proceedings.

    5.  Standing Order No. 83B (Programming committees) shall not apply to proceedings on consideration and Third Reading.

Programming of other proceedings

    6.  Any other proceedings on the Bill (including any proceedings on consideration of Lords Amendments or on any further messages from the Lords) may be programmed.
