NEW CLAUSES RELATING TO THE GENERAL DUTIES OF LOCAL EDUCATION AUTHORITIES IN RELATION TO THE PROVISION OF EDUCATION

To move the following Clause:—

    '(1)   A local education authority must prepare a local education plan for its area.

    (2)   The following matters must be included in a local education plan—

      (a) the authority's strategy for meeting demand for school places;

      (b) the admissions criteria for each school maintained by the authority;

      (c) the authority's plans to improve standards at those schools;

      (d) action plans, agreed with the schools to which they relate, for schools which need to improve pupil attainment levels;

      (e) educational provision for persons aged between 16 and 19;

      (f) areas of social deprivation to which section [Areas of social deprivation] applies.

    (3)   Before preparing its local education plan the authority must consult—

      (a) representatives of governors of schools within its area;

      (b) representatives of schools within its area;

      (c) head teachers of primary schools within its area;

      (d) head teachers of secondary schools within its area;

      (e) representatives of parents of pupils attending schools within its area;

      (f) representatives of providers of further education within its area;

      (g) neighbouring local education authorities.

    (4)   Before including in its local education plan any proposal for the establishment of a new school the authority must consider the likely impact of the establishment of the new school on existing schools (including schools within the area of a neighbouring authority).

    (5)   Any person who is affected by a local education plan may make representations to the local education authority.

    (6)   The authority must—

      (a) consider any representations made to it under subsection (5);

      (b) respond to them within a reasonable period; and

      (c) review any part of the local education plan to which the representations relate.

    (7)   A person who has made representations under subsection (5) and is dissatisfied with the authority's response under subsection (6)(b) may make representations to the Secretary of State.

    (8)   The Secretary of State must refer any representations under subsection (7) to an adjudicator who shall report his findings to the Secretary of State.

    (9)   After the Secretary of State has considered the adjudicator's findings he may, if he sees fit, direct the authority to amend its local education plan.

    (10)   A local education authority must review its local education plan every four years.

    (11)   In this section "school" means—

      (a) a community, foundation or voluntary school,

      (b) a community or foundation special school, or

      (c) an academy, city technology college or city college for the technology of the arts.'.

    '(1)   This section applies to any area designated in a local education plan as an area of social deprivation.

    (2)   The Secretary of State may by regulations prescribe the criteria to be used by a local education authority in determining whether to designate any part of its area as an area of social deprivation.

    (3)   The Secretary of State and the local education authority must exercise their powers with a view to ensuring that each school within an area of social deprivation receives resources which are sufficient to meet the educational needs of the children which it serves and to enable those children to achieve their full potential.

    (4)   In this section "school" means—

      (a) a community, foundation or voluntary school,

      (b) a community or foundation special school, or

      (c) an academy, city technology college or city college for the technology of the arts.'.

    '(1)   The Secretary of State and the local education authority must exercise their powers with a view to ensuring that any secondary school whose intake is drawn disproportionately from children of average and below-average ability receives resources which are sufficient to meet the educational needs of the children which it serves and to enable those children to achieve their full potential.

    (2)   In this section "school" means—

      (a) a community, foundation or voluntary school, or

      (b) an Academy, city technology college or city college for the technology of the arts.'.
