3European Standing Committee,—John Bercow reported from a European Standing Committee the following Resolution:

That the Committee takes note of European Union Document No. 6520/06 and Addendum 1, Commission Communication on strengthened practical cooperation: New structures, new approaches: improving the quality of decision making in the common European asylum system; notes that this forms part of the package of measures creating a Common European Asylum System, and supports the Government’s position that it is desirable to promote operational co-operation between Member States, with the aim of improving the efficiency and quality of Member States’ asylum systems.

8Future EU Finances and Own Resources,—A Motion was made, and the Question being proposed, That this House takes note of European Union Documents No. 5973/06, the Commission’s revised Proposal for renewal of the Inter-institutional Agreement on budgetary discipline and improvement of the budgetary procedure, No. 6426/06, the Commission Contribution to the Inter-institutional Negotiations on the Proposal for renewal of the Inter-institutional Agreement on budgetary discipline and improvement of the budgetary procedure, and No. 7241/1/06, Draft Decision on the system of the European Communities’ own resources (//EC, Euratom); and supports the Government’s objective of securing agreement on the Inter-institutional Agreement for the 2007–13 Financial Perspective and the Own Resources Decision in line with the agreement reached by Heads of Government at the December European Council—(Mr Geoffrey Hoon);

9Royal Assent,—The Deputy Speaker notified the House, in accordance with the Royal Assent Act 1967, That Her Majesty had signified her Royal Assent to the following Act, agreed upon by both Houses:

10Civil Aviation Bill,—Derek Twigg reported from the Committee appointed to draw up Reasons to be assigned to the Lords for disagreeing to certain of their Amendments to the Civil Aviation Bill, That it had drawn up the following Reason, which it had directed him to report to the House:

The Commons disagree to Lords Amendments Nos. 1, 2 and 4 for the following Reason:

Because it is not appropriate to require aerodrome authorities to fix their charges in the manner proposed.

PRAYERS.

1Misuse of Drugs (Reclassification of Methylamphetamine),—A Motion was made, and the Question being proposed, That leave be given to bring in a Bill to reclassify methylamphetamine as a category A drug—(Bob Spink);

And the Motion being opposed, after a brief explanatory statement from the Member who made the Motion and from a Member who opposed it, the Speaker put the Question, pursuant to Standing Order No. 23 (Motions for leave to bring in bills and nomination of select committees at commencement of public business):—It was agreed to.

Ordered, That Bob Spink, James Duddridge, Angus Robertson, Mr George Mudie, Mr Robert Goodwill, Mr Brooks Newmark, Angela Watkinson, Mr Lee Scott, Mr Philip Hollobone, Ann Winterton and Philip Davies do prepare and bring in the Bill.

2Misuse of Drugs (Reclassification of Methylamphetamine) Bill,—Bob Spink accordingly presented a Bill to reclassify methylamphetamine as a category A drug: And the same was read the first time; and ordered to be read a second time on Friday 20th October and to be printed [Bill 179].

3Opposition Day (15th allotted day),—It being an allotted day at the disposal of the Leader of the Opposition in pursuance of Standing Order No. 14 (Arrangement of public business), the House proceeded to consider Opposition business.

Management of the National Health Service by the Department of Health,—A Motion was made, and the Question being proposed, That this House notes the current financial crisis and associated job losses, ward and bed closures and service reductions in the NHS; believes that these are consequences primarily of the failures of management at the Department of Health; further notes the Secretary of State for Health’s denial of responsibility for this situation and her failure to recognise the realities within the NHS; sees a lack of leadership within the Department of Health; and, in addition to turnaround teams in NHS Trusts, calls on the Government to appoint a turnaround team to the Department of Health—(Mr Andrew Lansley);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House’ to the end of the Question and add the words ‘recognises the effective leadership given by the Department of Health in managing the NHS; acknowledges that the majority of NHS organisations are living within their budget and providing patients with better services; welcomes the turnaround in the NHS since 1997 as a result of the dedication and commitment of staff, backed by the Government’s programme of investment and reform; congratulates the Government for trebling investment in the NHS by 2008 compared with 1997; welcomes the recruitment of more than 300,000 extra staff in the NHS since 1997 including 85,000 more nurses; notes that waiting lists are now at their lowest since records began with over 370,000 fewer patients waiting for an operation than in March 1997; further welcomes the fact that all patients can now expect to wait no longer than six months for their operation and that 98 per cent. of patients are now seen, treated or admitted within four hours in accident and emergency departments; and applauds the NHS for saving more lives than ever before, including 43,000 more people saved from cancer and 87,000 saved from coronary heart disease’, instead thereof.—(Ms Secretary Hewitt.)

Referendums on proposals to alter police areas

20A After section 33 (Objections to alterations proposed by Secretary of State) there is inserted—

“33A Referendums on proposals to alter police areas

(1) Before making an order under section 32 the Secretary of State shall by order cause a referendum to be held in every area affected about the proposed alteration in police areas.

(2) The Secretary of State shall make an order under subsection (1)—

(a) in relation to a proposed alteration made under section 32(3)(a), after he has received a request under that subsection;

(b) in relation to a proposed alteration made under section 32(3)(b), after he has given further notice to objectors under section 33(4)(b).

(3) The question to be asked in a referendum to be held in pursuance of an order under subsection (1) above shall be agreed by—

(a) the Secretary of State,

(b) each police authority affected by the proposed alteration, and

(c) the Electoral Commission.

and specified in the order.

(4) The Secretary of State shall, in consultation with—

(a) each police authority affected by the proposed alteration, and

(b) the Electoral Commission

ensure that an order made under subsection (1) above makes such provision as is necessary to secure the proper conduct of a referendum.

(5) No order shall be made under subsection (1) above unless a draft of the order has been laid before and approved by resolution of each House of Parliament.

(6) The Secretary of State shall not exercise his power to make an order under section 32 unless a majority of votes cast in a referendum held under this section in each of the existing areas affected supports the proposed alteration.”’.— (Nick Herbert.)

The Lords have come to the following Resolution, to which they desire the agreement of this House:

That it is expedient that a Joint Committee of Lords and Commons be appointed to consider and report on any draft Legal Services Bill presented to both Houses by a Minister of the Crown, and that the Committee should report on the draft Bill by 25th July 2006.
