Cystic Fibrosis (Exemption from Prescription Charges) Bill

Bill

To

exempt persons with cystic fibrosis from charges for drugs, medicines,

appliances and pharmaceutical services; and for connected purposes. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Amendment of the National Health Service Act 2006

(1)   

The National Health Service Act 2006 (c. 41) is amended as follows.

(2)   

In section 173 (exemptions from general charging)—

(a)   

after paragraph (1)(d), insert—

“(e)   

the supply of any drug, medicine, appliance or

pharmaceutical service for a person with a valid

exemption certificate issued by the Secretary of State on

the ground that he is suffering from cystic fibrosis.”.

(b)   

after subsection (3), insert—

“(4)   

A valid exemption certificate for the purposes of sub-paragraph

(1)(e) above shall be in such form as the Secretary of State may

by regulations prescribe.”.

 Amendment of the National Health Service (Wales) Act 2006

(1)   

The National Health Service (Wales) Act 2006 (c. 42) is amended as follows.

(2)   

In section 122 (exemptions from general charging)—

(a)   

after paragraph (1)(d), insert—

“(e)   

the supply of any drug, medicine, appliance or

pharmaceutical service for a person with a valid

exemption certificate issued by the Welsh Ministers on

the ground that he is suffering from cystic fibrosis.”.

(b)   

after subsection (3), insert—

“(4)   

A valid exemption certificate for the purposes of sub-paragraph

(1)(e) above shall be in such form as the National Assembly for

Wales may by regulations prescribe.”.

Amendment of the English charging regulations

(1)   

The National Health Service (Charges for Drugs and Appliances) Regulations

2000 (S.I. 2000/620) are amended as follows.

(2)   

In Article 7(1)(e)(ii) (disorders in respect of which no charge shall be payable

by persons with a valid exemption certificate), at the beginning of the list of

disorders, insert—

“cystic fibrosis”.

4       

Amendment of the Welsh charging regulations

(1)   

The National Health Service (Charges for Drugs and Appliances) (Wales)

Regulations 2001 (S.I. 2001/1358) are amended as follows.

(2)   

In Article 8(1)(d)(ii) (disorders in respect of which no charge shall be payable

by persons with a valid exemption certificate), at the beginning of the list of

disorders, insert—

“cystic fibrosis”.

National Health Service Budget

No provision of this Act shall require money to be provided by Parliament to

increase the sums allocated to the National Health Service in England or Wales.

6       

Short title, commencement and extent

(1)   

This Act may be cited as the Cystic Fibrosis (Exemption from Prescription

Charges) Act 2007.

(2)   

Sections 1 and 3 shall come into force on 1st June 2007.

(3)   

Sections 2 and 4 shall come into force on such day as the Welsh Ministers may

by order appoint.

(4)   

The power to make orders under this section is exercisable by statutory

instrument.

(5)   

This Act extends to England and Wales only.
