Page 16, line 21 [Clause 37], at end insert—

      ‘(3) Section 26 of the Freedom of Information (Scotland) Act 2002 (asp 13) (prohibitions on disclosure) does not, by virtue of section 36 above, apply to personal information which—

        (a) is held by a Scottish public authority who has received it directly or indirectly from the Board, and

        (b) is not held by that authority on behalf of the Board.

      (4) In subsection (3) “Scottish public authority” has the same meaning as in the Freedom of Information (Scotland) Act 2002.’.

Page 28, line 11 [Clause 57], at end insert—

      ‘( ) Section 57 of the Local Electoral Administration and Registration Services (Scotland) Act 2006 (asp 14) (which provides for a central register kept by the Registrar General for Scotland for health and local authority purposes) is amended as follows—

        (a) in subsection (2), in paragraph (d), after “department” insert “or an NHS body”;

        (b) after that subsection, insert—

      “(2A) In subsection (2)(d), “NHS body” has the same meaning as it has (apart from in Schedule 15) in the National Health Service Act 2006 (c. 41).”’.

      ‘(3) In the Notes to Schedule 2, after the paragraph relating to the Ministry of Defence insert—

    Statistics Board

      In the case of the Statistics Board, no investigation is to be conducted in relation to any action taken by or on behalf of the Board in the exercise of any of its functions where the function is being exercised only in relation to Scottish devolved statistics (within the meaning of section 63 of the Statistics and Registration Service Act 2007).”

      (4) The Scottish Public Services Ombudsman Act 2002 (asp 11) is amended in accordance with subsections (5) and (6).

      (5) In section 7 (matters which may be investigated: restrictions), after subsection (6A) insert—

      “(6B) The Ombudsman must not investigate action taken by or on behalf of the Statistics Board in the exercise of any of its functions unless the function is being exercised only in relation to Scottish devolved statistics (within the meaning of section 63 of the Statistics and Registration Service Act 2007).”

      (6) In schedule 2 (persons liable to investigation), after paragraph 91 (Security Industry Authority) insert—

“91A The Statistics Board.”’.

    To move the following Schedule:—

‘Commission for Official Statistics

    Tenure of office

    1 (1) Subject to paragraph 2 of this Schedule, a member of the Commission shall vacate his office—

      (a) if he ceases to be a Member of the House of Commons or the House of Lords;

      (b) if another person is appointed in his place.

    (2) Subject to sub-paragraph (1) above, a member of the Commission shall hold office for the duration of the Parliament in which he is nominated or appointed and for a further period provided by paragraph 2 of this Schedule.

    (3) A member of the Commission may resign at any time by notice to the Commission.

    (4) Past service is no bar to nomination or appointment as a member of the Commission.

    2 (1) Subject to sub-paragraph (2) below, on a dissolution of Parliament, the members of the Commission shall continue in office until members are nominated or appointed in their place.

    (2) Where at any time after Parliament has been dissolved, it appears that a member of the Commission who is not a Member of the House of Lords—

      (a) has not been validly nominated as a candidate in the ensuing general election; or

      (b) although so nominated, has not been elected as a Member of Parliament at that election

    that member shall resign from the Commission forthwith; but nothing in sub-paragraph (1) above or this sub-paragraph shall be taken as preventing any such member from resigning otherwise than in pursuance of this sub-paragraph.

    Chairman

3 The Commission shall elect a chairman from amongst its members (in this Act referred to as “the Chairman of the Committee”).

    Proceedings and business

    4 (1) The validity of any proceedings of the Commission shall not be affected by any vacancy among the members of the Committee or by any defect in the appointment or nomination of any member.

    (2) The Commission may determine its own procedures.

    (3) The Commission may appoint one of its members to act as chairman at any meeting of the Commission in the absence of the elected chairman of the Commission.’.

ORDER OF THE HOUSE [8TH JANUARY 2007]

       That the following provisions shall apply to the Statistics and Registration Service Bill:

Committal

        1. The Bill shall be committed to a Public Bill Committee.

Proceedings in Public Bill Committee

        2. Proceedings in the Public Bill Committee shall (so far as not previously concluded) be brought to a conclusion on Thursday 25th January 2007.

        3. The Public Bill Committee shall have leave to sit twice on the first day on which it meets.

Consideration and Third Reading

        4. Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion one hour before the moment of interruption on the day on which those proceedings are commenced.

        5. Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on that day.

        6. Standing Order No. 83B (Programming committees) shall not apply to proceedings on consideration and Third Reading.

Other proceedings

        7. Any other proceedings on the Bill (including any proceedings on consideration of Lords Amendments or on any further messages from the Lords) may be programmed.


STATISTICS AND REGISTRATION BILL (PROGRAMME) (NO. 2)

Mr Chancellor of the Exchequer

       That the Order of 8th January 2007 (Statistics and Registration Bill (Programme)) be varied as follows—

        1. Paragraphs 4 and 5 of the Order shall be omitted.

        2. Proceedings on consideration shall be taken in the following order:

        new Clauses 1 to 4; amendments relating to Clause 36; remaining new Clauses; amendments relating to Clauses 1 to 35; amendments relating to Clauses 37 to 73; new Schedules; amendments to Schedules; remaining proceedings on consideration.

        3. Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion at 9 p.m. at this day’s sitting.

        4. Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at 10.00 p.m. at this day’s sitting.
