To

Amend the Animals Act 1971 to limit strict liability for damage done by

animals. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Amendment of the Animals Act 1971

(1)   

The Animals Act 1971 (c. 22) is amended as follows.

(2)   

In section 2 (liability for damage done by dangerous animals), for subsection

(2)(b) substitute—

“(b)   

the likelihood of the damage or of its being severe was due to

characteristics of the animal which are abnormal to its species in

the particular circumstances.”

Short title and extent

(1)   

This Act may be cited as the Animals Act (Amendment) Act 2007.

(2)   

This Act does not extend to Scotland or to Northern Ireland.
