4European Standing Committee,—Mrs Janet Dean reported from a European Standing Committee the following Resolution:

That the Committee takes note of European Union documents No. 13401/06 and Addenda 1 and 2, Commission Communication Thematic Strategy for Soil Protection, and No. 13388/06, Draft Directive establishing a framework for the protection of soil and amending Directive 2004/35/EC; and supports the Government’s aim of ensuring that any new EU obligations in respect of the protection of soils and their functions are evidence-based, proportionate and cost effective and take full account of the principles of subsidiarity and better regulation, particularly in respect of Member States’ existing national legislation.

5Message from the Lords,—A Message was brought from the Lords as follows:

Parliamentary Constituencies (Amendment) Bill [Lords],—The Lords have passed a Bill to reduce the number of parliamentary constituencies; amend the rules governing the number of electors in each constituency; and for connected purposes; to which the Lords desire the concurrence of this House.

The Lords do not insist on their Amendments to the Corporate Manslaughter and Corporate Homicide Bill to which this House has disagreed and they agree without Amendment to the Amendments proposed by this House in lieu of those Amendments.

6Childcare Provision (Wales) Bill,—The Order for reading the Childcare Provision (Wales) Bill a second time on Friday 19th October was read and discharged.

Bill withdrawn.

7New Members make Affirmation,—

Virendra Kumar Sharma, Esquire, Member for Ealing, Southall, made the Affirmation required by law.

Philip Wilson, Esquire, Member for Sedgefield, made the Affirmation required by law.

8Standards and Privileges,—A Motion was made, and the Question being proposed, That this House—

(i) approves the Sixth Report of the Committee on Standards and Privileges (House of Commons Paper No. 909); and

(ii) accordingly suspends Mr George Galloway, Member for Bethnal Green and Bow, from the service of the House from Monday 8th October for a period of eighteen sitting days; and in calculating that period paragraph (3) of Standing Order No. 12 (House not to sit on certain Fridays) shall not apply—(Mr Michael Foster);

Mr George Galloway, Member for Bethnal Green and Bow, having wilfully disregarded the authority of the Chair, was named by Mr Speaker, pursuant to Standing Order No. 43 (Disorderly conduct).

Whereupon a Motion was made, and the Question being put forthwith pursuant to Standing Order No. 44 (Order in debate), That Mr George Galloway be suspended from the service of the House—(Ms Harriet Harman):—It was agreed to.

(i) approves the Sixth Report of the Committee on Standards and Privileges (House of Commons Paper No. 909); and

(ii) accordingly suspends Mr George Galloway, Member for Bethnal Green and Bow, from the service of the House from Monday 8th October for a period of eighteen sitting days; and in calculating that period paragraph (3) of Standing Order No. 12 (House not to sit on certain Fridays) shall not apply.

9Forced Marriage (Civil Protection) Bill [Lords] (Programme) (No. 2),—Ordered, That the Order of 10th July 2007 (Forced Marriage (Civil Protection) Bill [Lords] (Programme)) be varied as follows:

1. Paragraphs 4 and 5 of the Order shall be omitted.

2. Proceedings on consideration and on Third Reading shall (so far as not previously concluded) be brought to a conclusion three hours after the commencement of proceedings on the Motion for this Order.—(Mr Wayne David.)

10Forced Marriage (Civil Protection) Bill [Lords],—The House, according to Order, proceeded to consider the Forced Marriage (Civil Protection) Bill [Lords], not amended in the Public Bill Committee.

The Bill was read the third time, and passed, without Amendment.

11Criminal Law,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 118 (Delegated Legislation Committees), That the draft Criminal Justice and Court Services Act 2000 (Amendment) Order 2007, which was laid before this House on 21st May, be approved—(Mr Wayne David):—It was agreed to.

12Investigatory Powers,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 118 (Delegated Legislation Committees), That the draft Regulation of Investigatory Powers (Acquisition and Disclosure of Communications Data: Code of Practice) Order 2007, which was laid before this House on 11th June, be approved—(Mr Wayne David):—It was agreed to.

21Global Approach to Migration,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 119 (European Standing Committees), That this House takes note of European Union Documents No. 9773/07, Commission Communication on the application of the EU Global Approach to Migration to the Eastern and South-Eastern Regions Neighbouring the European Union and No. 9776/07, Commission Communication on circular migration and mobility partnerships between the European Union and third countries; and supports the Government’s position that the expansion of the Global Approach to Migration provides an opportunity to assess progress so far as well as explore and clarify the concepts of circular migration and mobility partnerships—(Mr Wayne David):—It was agreed to.

9Criminal Damage (Graffiti) Bill,—James Duddridge accordingly presented a Bill to make provision for offences relating to graffiti; and for connected purposes: And the same was read the first time; and ordered to be read a second time on Friday 19th October and to be printed [Bill 150].

10Opposition Day [18th allotted day],—It being an allotted day at the disposal of the Leader of the Opposition in pursuance of Standing Order No. 14 (Arrangement of public business), the House proceeded to consider Opposition business.

Government’s handling of the penal system,—A Motion was made, and the Question being proposed, That this House considers that the Government’s management of the prison system has become a national disgrace; believes that the Government by ignoring official projections of the prison population and failing to plan for sufficient capacity has allowed jails to become overcrowded, reconviction rates to rise and the Probation Service to become overstretched; further considers that the Government’s resort to releasing prisoners early, including violent offenders, without risk assessment or accommodation checks is wholly unacceptable; notes that many of those released under the scheme have previously been refused release on Home Detention Curfew and that others have already re-offended when they should have been in custody; is concerned that offenders are also being transferred early to open prisons from which they can and do abscond at any time and that over 4,000 offenders released early on electronic tags have re-offended, committing over 1,000 violent crimes; further believes that the modest additional prison capacity announced by the Government will be insufficient; and calls upon the Government to halt the End of Custody Licence scheme and take immediate steps to ensure adequate prison capacity, the proper treatment and rehabilitation of offenders, and the safety of the British public—(Nick Herbert);

Policy on Global Poverty,—A Motion was made, and the Question being proposed, That this House reaffirms the cross-party commitment to increase the aid budget to 0.7 per cent. of gross national income by 2013; recognises the ability of effectively organised aid to contribute to sustainable economic development in low income countries; acknowledges the need to avoid imposing over-prescriptive conditions on aid; supports the wider use of tracking surveys and independent accounting as well as increased independent scrutiny of the United Kingdom’s aid budget to make the ultimate destination of aid payments more transparent; welcomes the suggestion that donors should work together in partnership trusts to ensure coordination of bilateral aid budgets in each recipient country; and urges the Government to work towards the unilateral removal by the EU of trade barriers against low income countries—(Mr Oliver Letwin);
