‘(1A) The rules must provide for charges payable in relation to a complaint to be reduced or waived (or partly or wholly refunded) where—

(a) the complaint is determined or otherwise resolved in favour of the respondent, and

(b) the ombudsman is satisfied that the respondent took all reasonable steps to try to resolve the complaint under the respondent’s complaints procedures.

(1B) The rules may make provision as to—

(a) the circumstances in which a complaint is to be treated as determined or other wise resolved in favour of the respondent (which may include circumstances where a complaint is settled, withdrawn or abandoned (or treated as withdrawn or abandoned by virtue of scheme rules));

(b) matters to be taken into account by the ombudsman for the purposes of subsection (1A)(b).

(1C) The respondent’s complaints procedures are the procedures established by the respondent, or which the respondent participates in or is subject to, in accordance with regulatory arrangements (or licensing rules of the Board) made in accordance with section 112.’.—(Bridget Prentice.)

5Access to Pension Protection Fund Benefits Bill,—Mr Mark Hendrick accordingly presented a Bill to make provision for the accessing of Pension Protection Fund benefits by people under the age of 50 who are suffering from a terminal illness; and for connected purposes: And the same was read the first time; and ordered to be read a second time on Friday 19th October and to be printed [Bill 161].

6Opposition Day [20th allotted day: first part],—It being an allotted day at the disposal of the Leader of the Opposition in pursuance of Standing Order No. 14 (Arrangement of public business), the House proceeded to consider Opposition business.

Government handling of the outbreaks of foot and mouth and bluetongue disease,—A Motion was made, and the Question being proposed, That this House notes the swift action taken by the Department for Environment, Food and Rural Affairs to impose movement controls when foot and mouth was first confirmed on 3rd August, in contrast to the Government’s failures in 2001; is alarmed that the outbreak originated from a laboratory site financed, licensed and inspected by the Government; notes that warnings about the inadequacies of the facilities at Pirbright were ignored; condemns this negligent approach to biosecurity; urges the Government to accept its responsibility for the situation facing farmers caused by the subsequent controls which for many has been compounded by the outbreak of bluetongue disease; and demands that the regulatory body for facilities using dangerous pathogens should be fully independent of the facilities’ major customers.—(Mr James Paice);

An Amendment was proposed to the Question, in line 2, to leave out from the word ‘House’ to the end of the Question and add the words ‘expresses great sympathy with farmers and the farming industry and acknowledges the difficulties they are facing as a result of the outbreaks of foot and mouth disease and bluetongue; recognises the work that has already been done by the Department for the Environment, Food and Rural Affairs, Animal Health, farmers and their representative bodies and others in containing foot and mouth; agrees that the priority for the Government must be to work with the farming industry and others to support the resumption of market activity as quickly as possible; and notes the steps the Government has taken to deal with what happened at the Pirbright laboratory site.’, instead thereof.—(Secretary Hilary Benn.)

Resolved, That this House expresses great sympathy with farmers and the farming industry and acknowledges the difficulties they are facing as a result of the outbreaks of foot and mouth disease and bluetongue; recognises the work that has already been done by the Department for the Environment, Food and Rural Affairs, Animal Health, farmers and their representative bodies and others in containing foot and mouth; agrees that the priority for the Government must be to work with the farming industry and others to support the resumption of market activity as quickly as possible; and notes the steps the Government has taken to deal with what happened at the Pirbright laboratory site.
