London Local Authorities Bill [Lords]

Jim Fitzpatrick, Minister for London, Department for Trade and Industry, has made the following report:

“1. Standing Order 169A of the House of Commons requires me to report on this Bill in respect of whether in my view the promoters have undertaken a full assessment of the compatibility of their proposals with the European Convention on Human Rights.

2. When the Bill was introduced to the House of Lords in January 2005, the Minister for Housing and Planning and for London reported that, in his opinion, that the promoters had failed to undertake an adequate assessment of the compatibility of their proposals with the European Convention of Human Rights in respect to the following clauses in the Bill introduced in the House of Lords:

    Clause 78(1) (visiting special treatment);
    Clauses 117 to 119 (disclosure of information); and
    Clause 120 (water pressure).

3. All these clauses were however subsequently withdrawn by the promoters during the passage of the Bill through the House of Lords.

4. I believe, as a result of these amendments, that the promoters have now undertaken a full assessment of the compatibility of their proposals with the European Convention on Human Rights, and I see no need to dispute their conclusions.”
