Bill

To

Make provision for the recording and publication of specified expenses

incurred by certain public servants; to promote transparency in the use of

public funds; and for connected purposes. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

1       

Duty to publish information on expenses

(1)   

Every public authority to which this Act applies must publish annually

information relating to expenses incurred by Board members in the previous

financial year.

(2)   

The information that must be published is specified in section 2.

(3)   

The information so specified must be published in—

(a)   

the annual report of the authority, or

(b)   

a separate document containing only the information required under

this Act, which must be published no later than three months after the

end of the financial year to which the information relates.

2       

Information to be published

The following information must be published in respect of each member of the

Board of each public authority—

(a)   

total expenditure incurred on travel in an official capacity by—

(i)   

private car,

(ii)   

licensed hire car or licensed taxi,

(iii)   

rail,

(iv)   

air,

(v)   

bicycle, and

(vi)   

other means;

(b)   

total expenditure incurred on—

(i)   

accommodation, and

(ii)   

subsistence,

   

whilst performing official duties;

(c)   

any other expenses or costs incurred which are incidental to or in

connection with the conduct of official business, including those

relating to any accompanying personal staff;

(d)   

total expenditure on the matters listed in this section incurred on

official business in—

(i)   

the United Kingdom, and

(ii)   

countries other than the United Kingdom.

Meaning of public authority

(1)   

For this purposes of this Act, “public authority” means only—

(a)   

those bodies listed in Parts VI and VII of Schedule 1 of the Freedom of

Information Act 2000 (c. 36), and

(b)   

any other body which may by regulations be prescribed by the

Secretary of State.

(2)   

Regulations under this section shall be subject to annulment by either House of

Parliament.

Expenses

There shall be paid out of money provided by Parliament any increase attributable to

this Act in the sums payable out of money so provided under any other enactment.

5       

Interpretation

In this Act—

“Board” means the board of directors or similar body;

“licensed hire car” has the meaning given by section 13(3) of the Transport

Act 1985 (c. 67);

“licensed taxi” has the meaning given by section 13(3) of the Transport Act

1985;

“official business” and “official duties” include activities undertaken as a

member of the authority and of any group to which a person is

nominated as a representative of that authority where the costs are

borne by the nominating authority;

“private car” expenses include a mileage allowance and parking expenses.

Commencement and short title

(1)   

This Act comes into force on the day twelve months after the last day of the

financial year in which it is passed.

(2)   

This Act may be cited as the Expenses of Public Servants (Publication) Act 2008.
