Make
requirements regarding the minimum size of print in certain
|
|
|
documents, including those relating
to advertising and contracts; and for
|
|
|
|
|
Be
it enacted by the Queen’s most Excellent Majesty, by
and with the advice and
|
|
|
consent of the Lords Spiritual
and Temporal, and Commons, in this present
|
|
|
Parliament assembled, and by
the authority of the same, as follows:—
|

Presentation
of terms and conditions within contracts and advertisements
|
|
|
(1)
|
The Secretary of State must,
within 12 months of the date on which this Act is
|
|
|
passed, make regulations about
the minimum size of text used in terms and
|
|
|
conditions in advertisements
and contracts relating to the provision of goods
|
|
|
|

(2)
|
Different requirements may be
set for different types and parts of
|
|
|
advertisements, documents and
contracts.
|
|
|
(3)
|
Before making regulations under
subsection (1), the Secretary of State shall
|
|
|
consult any organisation he considers
appropriate.
|
|
|
(4)
|
The Secretary of State may,
by regulations, vary the requirements set out in
|
|
10
|
regulations made under subsection
(1).
|
|
|
(5)
|
Regulations made under this section
shall be made by statutory instrument.
|
|
|
(6)
|
A statutory instrument containing
regulations under this section is subject to
|
|
|
annulment in pursuance of a resolution
of either House of Parliament.
|
|
|

Failure
to comply with requirements
|
|

Any person who enters into a
contractual relationship on the basis of the terms
|
|
|
or conditions set out in an advertisement
or contract to which this Act applies
|
|
|
shall not be bound by that agreement
unless those terms or conditions comply
|
|
|
with the regulations made under
section 1.
|
