To

Make provision for the establishment of an inquiry into the war on Iraq; and

for connected purposes. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Establishment of inquiry

(1)   

The Secretary of State shall cause an inquiry to be held under the Inquiries Act

2005 (c. 12) in relation to the participation of the United Kingdom in the war on

Iraq since 2003.

(2)   

The inquiry shall be known as the Iraq War Inquiry.

(3)   

The Secretary of State shall appoint an inquiry panel of up to 12 members, one

of whom shall be appointed as chairman.

(4)   

The Secretary of State may pay to members of the panel such remuneration and

allowances as he considers appropriate.

Terms of reference

(1)   

The terms of reference of the inquiry shall be to conduct an investigation into

the—

(a)   

origins,

(b)   

inception,

(c)   

legality, and

(d)   

conduct,

of the war.

(2)   

The inquiry panel may make recommendations on any matter within its terms

of reference.

Reports

(1)   

A report of the inquiry shall be published in accordance with section 25 of the

Inquiries Act 2005 (publication of reports), save that subsection (4)(b) shall not

apply.

(2)   

A report published under subsection (1) shall be laid before Parliament no later

than one year after the setting-up date in respect of the inquiry panel,

determined in accordance with section 5 of that Act.

(3)   

A Minister of the Crown shall, as soon as is practicable after the laying of a

report before Parliament under subsection (2), make a motion in each House of

Parliament expressing a view on the contents of the report.

(4)   

The chairman of the inquiry panel may deliver interim reports, which the

Secretary of State may publish.

Expenses

There shall be paid out of money provided by Parliament any expenditure incurred by

the Secretary of State by virtue of this Act.

5       

Short title

This Act may be cited as the Iraq War Inquiry 2008.
