| Page 52, line 33, at end insert— |
| "(8A) | This subsection applies if the Panel or Council is satisfied that deciding the application in accordance with any relevant national policy statement would be inconsistent with the objective of achieving sustainable development and avoiding so far as is reasonably practicable damage to or the deterioration of the matters listed in subsection (8B). |
| (8B) | The matters referred to in subsection (8A) are— |
| (a) | health and wellbeing, |
| (b) | the environment including biodiversity, |
| (c) | natural resources, and |
| (8C) | For the purposes of this section the Panel or Council must have regard to guidance relating to sustainable development issued by the Secretary of State." |
