To

Exclude the offence of theft from retail and commercial premises from the

provisions of the Criminal Justice and Police Act 2001 relating to fixed penalty

notices; and for connected purposes. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Amendment of Criminal Justice and Police Act 2001

In section 1 of the Criminal Justice and Police Act 2001 (c. 16) (offences leading

to penalties on the spot) insert—

“(1A)   

The entry in the Table in subsection (1) relating to section 1 of the Theft

Act 1968 does not apply to theft from retail and commercial premises.”

Short title and extent

(1)   

This Act may be cited as the Theft from Shops (Penalties) Act.

(2)   

This Act extends to England and Wales only.
