Exclude the offence of theft from retail and commercial premises from the |
| |
provisions of the Criminal Justice and Police Act 2001 relating to fixed penalty |
| |
notices; and for connected purposes. |

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and |
| |
consent of the Lords Spiritual and Temporal, and Commons, in this present |
| |
Parliament assembled, and by the authority of the same, as follows:— |

1 | Amendment of Criminal Justice and Police Act 2001 |
| |
In section 1 of the Criminal Justice and Police Act 2001 (c. 16) (offences leading |
| |
to penalties on the spot) insert— |
| |
“(1A) | The entry in the Table in subsection (1) relating to section 1 of the Theft |
| |
Act 1968 does not apply to theft from retail and commercial premises.” |

(1) | This Act may be cited as the Theft from Shops (Penalties) Act. |
| |
(2) | This Act extends to England and Wales only. |
