Letter to Parliamentary and Relations Devolution Team, Foreign and Commonwealth Office

  The Committee is looking forward to the oral evidence sessions on the IGC with the Minister for Europe on 12 September and with the Foreign Secretary on 10 October.

  The Committee has asked me, in advance of the first of those sessions, to seek detailed answers to the following questions. What is the legal status of the Declaration on CFSP contained in the mandate agreed at the June Council? If the Declaration and the Treaty provisions are perceived to conflict, what will be the mechanism for determining which takes primacy? In what circumstances will decisions on the role of the High Representative of the Union for Foreign Affairs and Security Policy in CFSP implementing measures be subject to QMV?

  I would be grateful to receive a response to this letter by 5 September.
