Clause  1,  page  1,  line  5,  leave out ‘make’ and insert ‘lay before Parliament a draft

Member’s explanatory statement

 

This amendment is part of a set of amendments which provides that regulations under clause 1 may

 

be made only if Parliament has approved a draft of the regulations. This particular amendment

 

requires the Secretary of State to lay such a draft before Parliament.

Clause  1,  page  1,  line  20,  leave out subsections (4) and (5) and insert—

 

‘(4)    

If a draft laid under subsection (2) is approved by a resolution of each House of

 

Parliament, the Secretary of State must by statutory instrument make regulations in

 

the terms of the draft.’.

This amendment is part of the same set of amendments as amendments 1 and 2. It requires the

 

Secretary of State to make regulations if a draft of them has been approved by a resolution of each

 

House of Parliament.

Clause  2,  page  2,  line  3,  leave out from ‘means’ to end of line 4 and insert ‘average

 

weekly earnings for full-time and part-time workers in England and Wales and Scotland;’.

This amendment alters the definition of average weekly earnings.

‘(2)    

For the purposes of this Act average weekly earnings are to be estimated on the

 

basis of information published by the Statistics Board.’.

This amendment, which is related to amendment 4, provides that average weekly earnings are to be

 

estimated on the basis of information published by the Statistics Board (as established by the

 

Statistics and Registration Service Act 2007).
