Bill

To

Amend the Education and Inspections Act 2006 to establish standards in

schools for the support of children with specified health conditions; to make

provision about the inspection of such support; and for connected purposes. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Standards for support of children with specified health conditions

(1)   

Section 38 of the Education and Inspections Act 2006 (general duties of

governing body of maintained school) (c. 40) is amended as follows.

(2)   

After subsection (9) insert—

“(10)   

The governing body must produce and implement a medical

conditions policy that defines how it plans to support the needs of

children with specified health conditions.

(11)   

The medical conditions policy must include provision about—

(a)   

the means by which records of the specified health conditions of

children at the school are to be recorded and maintained; and

(b)   

the preparation of an individual healthcare plan for each child

with a specified health condition which sets out the needs of

that child arising from that condition.

(12)   

The medical conditions policy must include requirements relating to

the provision of appropriate training for school staff to support the

implementation of individual healthcare plans.

(13)   

In preparing an individual healthcare plan the governing body must—

(a)   

consult the parents of the child concerned and, where

appropriate, the child about the contents of the plan; and

(b)   

obtain the approval of the child’s parents for the plan.

(14)   

There shall be a duty on NHS bodies to co-operate with the governing

body in its preparation and implementation of individual healthcare

plans.

(15)   

Local authorities and primary care trusts must co-operate with

governing bodies in fulfilling their functions under this Act.

(16)   

The Secretary of State may by regulations define “specified health

conditions” for the purposes of this section.

(17)   

For the purposes of this section “NHS bodies” has the same meaning as

in the National Health Service Act 2006 (c. 41).”.

Inspection of standards

(1)   

Section 117 of the Education and Inspections Act 2006 is amended as follows.

(2)   

In subsection (2)(a) after “children” insert “, including the well-being of

children with specified health conditions within the meaning of the Schools

(Health Support) Act 2009”.

3       

Short title

(1)   

This Act may be cited as the Schools (Health Support) Act 2009.

(2)   

This Act comes into force at the end of the period of two months beginning on

the day on which it is passed.

(3)
