amend the Planning Act 2008 to require Parliamentary approval for proposals |
| |
for the building of new major airports and additional runways at existing |
| |
major airports; and for connected purposes. |

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and |
| |
consent of the Lords Spiritual and Temporal, and Commons, in this present |
| |
Parliament assembled, and by the authority of the same, as follows:— |

1 | National policy statements |
| |
In section 9 of the Planning Act 2008 (c. 29) (parliamentary requirements) after |
| |
| |
“(3A) | Subsection (3B) applies if the proposal sets out policy in relation to the |
| |
construction of a new major airport or of an additional runway at an |

| |
(3B) | The Secretary of State may not designate the proposal as a national |
| |
policy statement for the purposes of this Act unless it has been |
| |
approved by a resolution of each House of Parliament. |

(3C) | In subsection (3A) a “major airport” is an airport the construction of |

which falls within section 23(2).” |

2 | Decisions on applications for orders granting development consent |
| |
After section 117 of the Planning Act 2008 insert— |
| |
“117A | Parliamentary approval of orders granting development consent for |
| |

(1) | No order granting development consent for the construction of a new |
| |
major airport or of an additional runway at an existing major airport |
| |
shall have effect unless it has been approved by a resolution of each |
| |
| |
(2) | In subsection (1) a “major airport” is an airport the construction of |

which falls within section 23(2).” |
