To move the following Clause:—

 

‘(1)    

The weekly rate of jobseeker’s allowance shall increase by £15 on 1 October

 

2009.

 

(2)    

The weekly rate of jobseeker’s allowance shall be increased on 1 October 2010,

 

and annually thereafter, in line with the percentage increase in average earnings

 

over the relevant annual interval to be prescribed in regulations.’.

 


 

Passporting of Jobseeker’s Allowance for retraining or employment protection

To move the following Clause:—

 

‘(1)    

The Jobseekers Act 1995 (c. 18) is amended as follows.

 

(2)    

After section 27 insert—

 

“27A  

Passporting of Jobseeker’s Allowance for retraining or employment

 

protection

 

(1)    

Regulations under this section may make provision for or in connection

 

with allowing Jobseeker’s Allowance to be passported to employers of

 

individuals who have been on Jobseeker’s Allowance for at least 6

 

months prior to their employment.

 

(2)    

Claimants to whom these regulations apply must be in receipt of the

 

national minimum wage.

 

(3)    

Regulations may further make provision for Jobseeker’s Allowance to be

 

passported to employers planning to make skilled or semi-skilled

 

workers redundant.

 

(4)    

Regulations under this section may only apply to employees who would

 

be entitled to Jobseeker’s Allowance if no longer in employment.

 

(5)    

The passported benefits must be used either—

 

(a)    

to retrain the worker concerned, or be

(b)    

to enable the worker to continue in employment at a reduced

 

capacity.”’.

 


 

Disability living allowance for blind claimants

Section 73 of the Social Security Contributions and Benefits Act 1992 (c. 4) (the

 

mobility component) is amended as follows.

 

(2)    

In subsection (1), after paragraph (b) insert—

 

“(ba)    

he falls within subsection (2A); or”.

 

(3)    

In subsection (1A) (a), after “(b)”, insert “, (ba)”.

 

(4)    

After subsection (2), insert—

 

“(2A)    

A person falls within this subsection if—

 

(a)    

he is blind; and

 

(b)    

he satisfies such other conditions as may be prescribed.”.

 

(5)    

In subsection (5), after “(2)(a)”, insert “or subsection (2A)(a)”.

 

(6)    

In subsection (11)(a), after “(b)”, insert “, (ba)”.’.

 


 

Grandparents’ national insurance credit

The Social Security Contributions and Benefits Act 1992 (c. 4) is amended as

 

follows.

 

(2)    

In section 23A(3)(c) (Contributions credits for relevant parents and carers), after

 

first “in” insert “unpaid care for 20 hours in that week or more of a grandchild

 

under the age of 12 or of an ill, frail or disabled family member, friend or partner,

Annual report on claimants moving into work

‘(1)    

The Secretary of State shall prepare an annual report on the operation of the

 

arrangements relating to incapacity benefit claimants and employment and

 

support allowance claimants and shall give details of the number of such

 

claimants who have moved off benefit and into work.

 

(2)    

A copy of each such report shall be laid before each House of Parliament.’.

 


 

Claimant’s Charter and Employment Services Ombudsman

To move the following Clause:—

 

‘(1)    

Regulations under this section shall make provision for a Claimant’s Charter to

 

set out the rights and duties of claimants under the provisions of this Act.

 

(2)    

The Claimant’s Charter shall apply to all functions exercised by the Secretary of

 

State under the provisions of this Act, including those contracted out under

 

section 23 of this Act.

 

(3)    

Regulations may provide for benefit claimants to have complaints against

 

providers of employment services investigated by an employment services

 

ombudsman in accordance with a scheme approved by the Secretary of State.’.

 


 

Work related activity: payment of additional premium

amended as follows.

Registrar not to enter father’s name in certain circumstances

‘Nothing in section 44 and Schedule 6 of this Act relating to the registration of

 

the births of children whose parents are neither married to each other nor civil

 

partner of each other shall permit the registrar to enter the name of a father on the

 

register in circumstances where—

 

(1)    

the mother confirms to the registrar that she has reason to fear for her

 

safety or that of her child if the father were to acquire parental

 

responsibility by virtue of his name being entered on the register; and

 

(2)    

a determination regarding the acquisition of parental responsibility by the

 

father under section 4(1)(c) of the Children Act 1989 as amended has not

 

yet been made by a court.’.

 


 

Mobility component of disability allowance

substitute—

 

“(ab)    

he falls within subsection (1AB) below; or

 

(b)    

he does not fall within that subsection but does fall within subsection (2)

 

below; or”.

 

(3)    

In subsection (1A)(a), after “paragraph (a),”, insert “(ab),”.

 

(4)    

After subsection (1A) insert—

 

“(1AB)    

A person falls within this subsection if—

 

(a)    

he has such severe visual impairment as may be prescribed; and

 

(b)    

he satisfies such other conditions as may be prescribed.”.
