| | (3) | An “Academy function” is a function of the Secretary of State relating to or |
|
| | exercisable in connection with— |
|
| | (a) | Academies, city technology colleges or city colleges for the technology |
|
| | |
| | (b) | a particular, or particular description of, Academy, city technology |
|
| | college or city college for the technology of the arts. |
|
| | (4) | Academy functions include in particular functions of the Secretary of State |
|
| | |
| | (a) | section 482 of the Education Act 1996 (c.56) (Academies) or an |
|
| | agreement entered into under section, |
|
| | (b) | Schedule 35A to that Act (Academies: land). |
|
|
|
| |
| |
|
| | (5) | References in a provision made by or under this or any other Act to the functions |
|
| | of the Chief Executive of Academies do not include any functions conferred or |
|
| | imposed on the Chief Executive of Acadmies under section [Academy |
|
| | |
| |
| | Grants for purposes of Academy arrangements functions |
|
| |
| |
| |
| |
| |
| |
| | |
| To move the following Clause:— |
|
| | ‘(1) | The Secretary of State may make grants to the Chief Executive of Academies for |
|
| | the purposes of any functions that are or may be conferred or imposed on the |
|
| | Chief Executive of Academies under section [Academy arrangements]. |
|
| | (2) | Grants to the Chief Executive of Academies under this section are to be made at |
|
| | such times and subject to such conditions (if any) as the Secretary of State thinks |
|
| | |
| | (3) | Conditions to which a grant is subject may (in particular)— |
|
| | (a) | require the Chief Executive of Academies to use the grant for specified |
|
| | |
| | (b) | require the Chief Executive of Academies to comply with specified |
|
| | requirements in respect of persons or persons of a specified description; |
|
| | (c) | enable repayment (in whole or part) to be required of sums paid by the |
|
| | Secretary of State if any condition subject to which the grant was made |
|
| | |
| | (d) | require the payment of interest in respect of any period during which a |
|
| | sum due to the Secretary of State in accordance with any condition |
|
| | |
| | (4) | Requirements which may be be imposed under subsection (3)(b) include in |
|
| | particular requirements that, if the Chief Executive of Academies provides |
|
| | specified financial resources, it is to impose specified conditions.’. |
|
| |
| | Academy arrangements: information sharing |
|
| |
| |
| |
| |
| |
| |
| | |
| To move the following Clause:— |
|
|
|
| |
| |
|
| | ‘(1) | This section applies if the Secretary of State and the Chief Executive of |
|
| | Academies enter into Academy arrangements. |
|
| | (2) | A person within subsection (3) may provide information to any other person |
|
| | within that subsection for the purpose of enabling or facilitating the exercise of |
|
| | |
| | |
| | (a) | the Secretary of State; |
|
| | (b) | the Chief Executive of Academies; |
|
| | |
| | (4) | A “relevant function” is— |
|
| | (a) | a functions conferred or imposed on the Chief Executive of Academies |
|
| | |
| | (b) | a function of the Secretary of State, or a relevant Academy which is |
|
| | exercisable in connection with a function conferred or imposed on the |
|
| | Chief Executive of Academies under the arrangements. |
|
| | (5) | A “relevant Academy” is an Academy, city technology college or city college for |
|
| | the technology of the arts in relation to which a function is exercisable by the |
|
| | Chief Executive of Academies under the arrangements. |
|
| | (6) | Nothing in this section— |
|
| | (a) | affects a power to disclose information that exists apart from this section, |
|
| | |
| | (b) | authorises the disclosure of any information in contravention of a |
|
| | provisions made by or under any Act which prevents disclosure of the |
|
| | |
| |
| | Children visited by key workers |
|
| |
| |
| |
| | |
| To move the following Clause:— |
|
| | ‘After section 16 of the Children Act 2004 insert— |
|
| | “16A (1) | A Children’s services authority shall secure that, when any child who |
|
| | |
| | (a) | an investigation under section 47 of the Children Act 1989; or |
|
| | (b) | a child protection plan agreed by the Local Safeguarding |
|
| | |
| | | is visited by his or her key worker, the child shall, if practicable and |
|
| | reasonable in the circumstances, be seen separately from his or her |
|
| | |
| | (2) | The key worker referred to in subsection (1) is— |
|
| | (a) | in the case of subsection (1)(a) of this section, the lead social |
|
| | worker appointed by the children’s services authority; and |
|
|
|
| |
| |
|
| | (b) | in the case of subsection (1)(b), the key worker appointed by |
|
| | the Local Safeguarding Children Board.”’. |
|
| |
| | |
| |
| |
| |
| | |
| To move the following Clause:— |
|
| | ‘(1) | A local education authority may provide registered students at— |
|
| | (a) | a sixth form college, or |
|
| | (b) | a further education college; |
|
| | who are over compulsory school age, but under 19, with lunches. |
|
| | (2) | Where provision is made under subsection (1) it shall be made in a case within |
|
| | paragraph (a) or (b) of that subsection, either on the college premises or at any |
|
| | other place where education is being provided. |
|
| | (3) | A local education authority shall exercise their power under subsection (1) to |
|
| | provide college lunches for any person if— |
|
| | (a) | any prescribed requirements are met; |
|
| | (b) | a request for the provision of college lunches has been made by or on |
|
| | behalf of that person to the authority; and |
|
| | |
| | (i) | that person is eligible for free lunches (as defined by section |
|
| | 512ZB (4) of the Education Act 1996), or |
|
| | (ii) | in the case of a person within subsection (1)(a), it would not be |
|
| | unreasonable for the authority to provide the lunches. |
|
| | (4) | Where the local education authority provides a lunch in accordance with |
|
| | subsection (3) to a person who is eligible for free lunches, the authority shall |
|
| | provide the meal free of charge.’. |
|
| |
| | Achievement and attainment tables |
|
| |
| |

| | |

|

|

| | ‘A Children’s Services Authority in England must ensure that the Local |
|
| | Safeguarding Board established by it has a chairman who is independent of that |
|

| | Support in the workplace for apprentices with learning difficulties |
|
| |
| |
| |
| | |
| To move the following Clause:— |
|
| | ‘(1) | The Chief Executive of Skills Funding has a duty to ensure that apprentices with |
|
| | learning difficulties receive support and assistance in the workplace. |
|
| | (2) | Provision of such support may include— |
|
| | (a) | special educational needs support for apprentices in the workplace aged |
|
| | |
| | (b) | the Access to Work Scheme. |
|
| | (3) | In discharging the duty in subsection (1) the Chief Executive shall provide |
|
| | assistance to employers and apprentices through the provision of information and |
|
| | |
| | (4) | In this section “support and assistance in the workplace” includes special |
|
| | educational needs provision (regardless of whether or not the apprentice is subject |
|
| | to a learning difficulty assessment) and the Access to Work scheme.’. |
|
| |
| | Parliamentary oversight of skills funding |
|
| |
| |
| |
| | |
| To move the following Clause:— |
|
| | ‘(1) | The Chief Executive of Skills Funding must prepare an annual report relating to |
|
| | the activities, functions and expenditure of the Skills Funding Agency. |
|
| | (2) | The report must be laid before Parliament.’. |
|
| |
|
|
| |

|
| | Persons aged 16 to 18 with learning difficulties |
|
| |
| |
| |
| | |
| To move the following Clause:— |
|
| | ‘(1) | The Chief Executive must, in performing the functions of the office, have regard |
|
| | to the needs of persons with learning difficulties to whom this section applies. |
|
| | (2) | This section applies to persons who are aged 16 to 18 who are not in possession |
|
| | of a learning difficulty assessment. |
|
| | (3) | For the purposes of this section, a person has a learning difficulty if— |
|
| | (a) | the person has a significantly greater difficulty in learning than the |
|
| | majority of persons of the same age, or |
|
| | (b) | the person has a disability which either prevents or hinders the person |
|
| | from making use of facilities of a kind generally provided by institutions |
|
| | providing education falling within section 92(1)(a) or (b).’. |

| | (2) | The report commissioned in subsection (1) shall be submitted to the Secretary of |
|
| | |
| | (3) | The Secretary of State must lay before Parliament a copy of the report received |
