provision about the holding of interviews between site owners

mobile homes prior to any sale. |

it enacted by the Queen’s most Excellent Majesty,
by and with the advice and |

consent of the Lords Spiritual
and Temporal, and Commons, in this present |

Parliament assembled, and
by the authority of the same, as follows:— |

Amendment
of Mobile Homes Act 1983 |
|
|
(1) |
Schedule 1 to the Mobile
Homes Act 1983 (c. 34) is amended as follows. |
|
|
(2) |
After paragraph 8(1D) insert— |
|
|
“(1DA) |
If the owner wishes
to interview the person before giving his |
|
|
approval,
the provisions of sub-paragraphs (1DB) to (1DF) shall |
|

(1DB) |
The interview must be conducted
in the presence of, and in the office |
|
|
|
|
(1DC) |
The solicitor must be acceptable
to both the owner and the person |
|
|
and
the fee for his services must be paid by the owner. |

(1DD) |
Before the interview the
solicitor must familiarise himself with this |
|
|
Act
and other relevant legislation. |
|
|
(1DE) |
The solicitor must satisfy
himself that the reasons given by the owner |
|
|
for
holding the interview are reasonable, that statements made by
|
|
|
the
owner to the person are not fraudulent, and that any references
|
|

by the person are satisfactory. |

(1DF) |
The owner must accept any
reference which the solicitor has found |
|

title and commencement |
|
|
(1) |
This Act may be cited as
the Sale of Mobile Homes (Interviews) Act 2009. |
