Bill

To

Establish a Commission to review the operation of the Criminal Injuries

Compensation Scheme and to make proposals for amendments to the Scheme.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Commission for the Review of the Criminal Injuries Compensation Scheme

(1)   

There shall be a Commission for Review of the Criminal Injuries

Compensation Scheme (“the Commission”).

(2)   

The Commission shall be composed of a Chairman of the Commission and no

more than four other members.

(3)   

The Secretary of State shall appoint the Chairman and other members of the

Commission.

(4)   

The Secretary of State shall determine the duration and terms of appointments

made under this section.

(5)   

The Secretary of State may make payments to the Chairman and other members of the

Commission in respect of expenses incurred by them in the performance of their duties.

(6)   

The Secretary of State may also defray any other expenses of the Commission.

2       

Functions of the Commission

(1)   

The function of the Commission is to review the operation of the Criminal

Injuries Compensation Scheme in respect of the matters specified in subsection

15

(2) and to make any proposals for amendment of the scheme in respect of those

matters.

(2)   

In accordance with subsection (1), the Commission may—

(a)   

review the payment of compensation to United Kingdom nationals

who are the victim of acts of terrorism committed in—

(i)   

the United Kingdom, and

(ii)   

outside the United Kingdom;

(b)   

take account of the financial costs incurred by victims as a consequence

of the terrorism incident.

3       

Reports from the Commission

(1)   

The Commission must complete its review and submit any report containing

recommendations to the Secretary of State no later than six months after the

date on which the members of the Commission are appointed.

(2)   

The Secretary of State must—

(a)   

lay a copy of the report received under subsection (1) before

Parliament; and

(b)   

make a motion in the House of Commons relating to the report no later

than three months after the date on which it is laid before Parliament.

4       

Expenses

There shall be paid out of money provided by Parliament any expenditure of the

Secretary of State in consequence of this Act.

5       

Short title and extent

(1)   

This Act may be cited as the Criminal Injuries Compensation Scheme (Review)

Act 2009.

(2)   

This Act does not extend to Northern Ireland.
