Indirect donations
34. Following the Committee's Tenth Report of Session
2007-08,[7] it is specified
that donations in support of a Member are registrable whether
they are given directly to the Member or made to the central party
organisation accompanied by a wish that it should be used to support
a particular individual or front-bench office.
Employment of family members
35. Following the Seventh Report of Session 2007-08,[8]
Members are required to register the name, relationship to them
and standard job title of any staff member, paid for out of the
staffing allowance, who is related to them by blood or by marriage
or a relationship equivalent to marriage. The Guide has been amended
to reflect this and also makes clear that this provision applies
to relatives paid out of any other House of Commons allowance,
including Short Money.
Procedure for Complaints
36. There are several changes to the Rules regarding
the submission of complaints. The exclusions from the Commissioner's
remit are set out more clearly; the description of the procedure
has been amended to remove the references to 'prima facie'
cases and 'preliminary investigations' (which have led to confusion);
there is a clearer description of the rectification procedure
(including a reference to its application in respect of the Registers
of Members' Staff, All-Party Groups and Journalists); specific
reference is made to self referral by Members and complaints relating
to events more than 7 years old, both of which the Committee would
expect to authorise only in exceptional circumstances; and a paragraph
has been inserted explaining the procedure in the case of frivolous
or vexatious complaints or those where investigation would be
disproportionate in view of the seriousness of the allegation.
