To

Require the Secretary of State to propose amendments to Article 17 of the

Warsaw Convention for the purpose of extending carrier liability to cases of

detriment to health or psychological well-being; and for connected purposes. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

1       

Duty to propose extension of carrier liability to cases of detriment to health or

psychological well-being

(1)   

The Secretary of State must propose to the parties to the Warsaw Convention

an amendment to the Convention as follows—

(a)   

in Chapter III (Liability of the Carrier), Article 17, after “any other

bodily injury”, insert “or detriment to health or psychological well-

being”.

(2)   

The Secretary of State must propose to the parties to the Montreal Convention

amendments to the Convention as follows—

(a)   

in Chapter III (Liability of the Carrier and Extent of Compensation for

Damage), Article 17 (1), after “bodily injury”, insert “or for damage

sustained in case of detriment to health or psychological well-being“;

and

(b)   

in Chapter III (Liability of the Carrier and Extent of Compensation for

Damage), Article 17 (1), after “or injury”, insert “or detriment to health

or psychological well-being”.

(3)   

The amendments to both Conventions must be proposed no later than 1 April

2011.

Interpretation

(1)   

In this Act—

“Montreal Convention” means the Convention for the Unification of

Certain Rules for International Carriage by Air done at Montreal on 28

May 1999, as set out in Schedule 1B of the Carriage by Air Act 1961; and

“Warsaw Convention” means the Warsaw Convention as amended at the

Hague, 1951 and as further amended by Protocol No 4 of Montreal,

1975, as set out in Schedule 1A of the Carriage by Air Act 1961.

Commencement, extent and short title

(1)   

This Act comes into force at the end of the period of 2 months beginning with

the day on which it is passed.

(2)   

This Act extends to England and Wales and Scotland.

(3)   

This Act may be cited as the Warsaw Convention (Carrier Liability) Act 2010.
