Exempt
the Department for Work and Pensions from statutory requirements

to retain files in written
form where it holds electronic files of the information |
|
|
in an approved form; and for
connected purposes. |

Be
it enacted by the Queen’s most Excellent Majesty,
by and with the advice and |
|
|
consent of the Lords Spiritual
and Temporal, and Commons, in this present |
|
|
Parliament assembled, and
by the authority of the same, as follows:— |

Department
for Work and Pensions: files |
|
|
(1) |
Notwithstanding the provisions
in any other enactment, the Secretary of State |
|
|
is under no obligation to
keep documents relating to relevant benefit claims in |
|
|
written form, provided that
the documents are stored in electronic form. |
|
|
(2) |
The Secretary of State may
by order made by statutory instrument make such |
|

amendments as necessary in
relevant legislation to bring into force subsection |
|
|
|
|
(3) |
In this Act “relevant
benefit claims” are those covered by the Social Security
|
|
|
and Child Support (Decisions
and Appeals) Regulations 1999 (SI 1999/991). |

(1) |
This Act may be cited as
the Department for Work and Pensions (Electronic |
|
|
File Retention) Act 2010. |
|
|
(2) |
This Act extends to England
and Wales. |
|
