The case for prior notification is simple, logical and irrefutable:
· By definition, something ceases to be private if it becomes public.
· The law requires certain things to be kept private.
· The court has a duty to enforce the law.
· The court can only enforce the law if informed.
· It can only be informed by the aggrieved party.
· He can only inform the court if he knows.
· Therefore he must be notified before publication.
