Varying of elections by the National Assembly for Wales

To move the following Clause:—

 

‘(1)    

Section 4 of the Government of Wales Act 2006 (“Power to vary date of ordinary

 

general election”) is amended as follows.

 

(2)    

In subsection (1) after “May”, insert “, subject to subsections (1A) and (1B)”.

 

(3)    

After subsection (1) insert—

 

“(1A)    

If the scheduled date for a National Assembly for Wales ordinary general

 

election is the same date as for a United Kingdom parliamentary general

 

election, the National Assembly of Wales general election must be

 

held—

 

(a)    

not less than two months, and

 

(b)    

not more than twelve months and one week before or after the

 

United Kingdom parliamentary general election.

 

(1B)    

The Secretary of State for Wales shall by order provide for the date of the

 

poll of the National Assembly for Wales ordinary general election, with

 

the agreement of the National Assembly for Wales, subject to subsection

 

(1A).”.’.

 


 

Power for the National Assembly for Wales to vary election dates and make provision

 

about elections to the National Assembly for Wales

In section 4(1), for “Secretary of State” substitute “National Assembly for

 

Wales”.

 

(3)    

Omit section 4(5).

In section 5(1), for “Secretary of State” substitute “National Assembly for

 

Wales”.

 

(5)    

In section 5(4), for “Secretary of State” substitute “National Assembly for

 

Wales”.

 

(6)    

In section 13(1), for “Secretary of State” substitute “National Assembly for

Variation of date of Scottish general elections (No. 1)

To move the following Clause:—

 

‘(1)    

The Scotland Act 1998 is amended as follows.

 

(2)    

In section 2(5) for “which is not more than one month earlier, nor more than one

 

month later, than the first Thursday in May” substitute “which is not more than

 

two months earlier, nor more than 12 months and one week later, than the original

 

date of an ordinary general election,”.’.

 


 

Variation of date of Scottish general elections (No. 2)

‘(1)    

The Scotland Act 1998 is amended as follows.

 

(2)    

In section 2(5) omit “which is not more than one month earlier, nor more than one

 

month later, than the first Thursday in May,”.’.

 


 

Application of Parliament Act 1911 to section 1

‘(1)    

The Parliament Act 1911 is amended as follows.

 

(2)    

In section 2(1), after “five years”, there is inserted “or a Bill amending section 1

 

of the Fixed-Term Parliaments Act 2010”.’.

 

 

Order of the House [13 September 2010]

 

That the following provisions shall apply to the Fixed-Term Parliaments Bill:

 

Committal

 

1.    

The Bill shall be committed to a Committee of the whole House.

 

Proceedings in Committee

 

2.    

Proceedings in Committee of the whole House shall be completed in two

 

days.

 

3.    

The proceedings shall be taken in the following order: Clauses 1 to 4; the

 

Schedule; Clause 5; new Clauses; new Schedules; remaining proceedings on

 

the Bill.

4.    

The proceedings shall (so far as not previously concluded) be brought to a

 

conclusion at the moment of interruption on the second day.

 

5.    

Standing Order No. 83B (Programming committees) shall not apply to the

 

proceedings on the Bill in Committee of the whole House.

 

Consideration and Third Reading

 

6.    

Proceedings on consideration shall (so far as not previously concluded) be

 

brought to a conclusion one hour before the moment of interruption on the

 

day on which those proceedings are commenced.

 

7.    

Proceedings on Third Reading shall (so far as not previously concluded) be

 

brought to a conclusion at the moment of interruption on that day.

 

8.    

Standing Order No. 83B (Programming committees) shall not apply to

 

proceedings on consideration and Third Reading.

 

Other proceedings

 

9.    

Any other proceedings on the Bill (including any proceedings on

 

consideration of Lords Amendments or on any further messages from the

 

Lords) may be programmed.
