In discharging its functions under this Act, the London Assembly police and

 

crime panel may—

 

(a)    

investigate complaints of misconduct against the Mayor’s Office for

 

Policing and Crime;

 

(b)    

institute misconduct proceedings against the Mayor’s Office for Policing

 

and Crime if, following an investigation under paragraph (a), it appears

 

to the panel that misconduct proceedings are necessary;

 

(c)    

make a report or recommendations to the Secretary of State on the

 

outcome of any investigation.’.

 

(3B)    

In discharging its functions under this Act, the London Assembly police and

 

crime panel may consult—

 

(a)    

the Commissioner of Police for the Metropolis;

 

(b)    

persons residing in the Metropolis;

 

(c)    

Her Majesty’s Inspector of Constabulary; or

 

(d)    

any other person as the London Assembly sees fit.

 

(3C)    

In discharging its functions under this Act, the London Assembly police and

 

crime panel may consider any views expressed, or complaints made by—

 

(a)    

the Commissioner of Police for the Metropolis;

 

(b)    

persons residing in the Metropolis; or

 

(c)    

any other person as the panel sees fit.’.

As the Bill stands, the London Assembly’s Police and Crime Panel has only the power to ‘summon’

 

the PCC and not senior police officers. This amendment would enable the Police and Crime Panel

 

to require the attendance of ACPO rank police officers in order to more effectively carry out its

 

work.

No person shall be appointed as a chief constable of a police force unless he holds

 

or has held the rank of—

 

(a)    

chief constable, deputy chief constable or assistant chief constable in a

 

police force maintained under section 2 of the Police Act 1996;

 

(b)    

commissioner, deputy commissioner, assistant commissioner or deputy

 

assistant commissioner in the metropolitan police force; or

 

(c)    

assistant commissioner in the City of London police force,

 

    

for a period of no less than three years.

 

(1B)    

No person shall be appointed as a chief constable of a police force unless he has

 

passed the Senior National Assessment Centre and completed the Strategic

 

Command Course.

 

(1C)    

Subject to this section an appointment to the rank of chief constable shall be for

 

a fixed term of five years.’.

‘1         

A police and crime panel must comply with this Part of this Schedule in

 

appointing a chief constable under section 38.

 

2          

A police and crime panel must not appoint a constable to be chief constable

 

until the agreement of a 75 per cent. majority of the panel has been secured.

 

3    (1)  

A police and crime panel must hold an appointment hearing before appointing

 

a chief constable.

 

      (2)  

For the purposes of this Part an “appointment hearing”, is a meeting of the

 

panel, held in public, at which the candidate is requested to appear for the

 

purposes of answering questions in relation to the appointment.

 

      (3)  

References in this part to a person appearing at a meeting of the panel are

 

references to the person—

 

(a)    

attending the meeting in person, or

 

(b)    

not attending the meeting in person but participating in the

 

proceedings at the meeting by any means that enable the person to

 

hear, and be heard in, those proceedings at the happen.’.
